A state Senate bill working its way toward the governor’s desk would prohibit the use of wage garnishment for collecting unpaid rent and other debts from most Californians.

The bill, SB 1477 [https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=202120220SB1477]
by state Sen. Bob Wieckowski, D-Fremont, would no longer allow wage garnishment for individuals earning $36 per hour or less. In areas of the state with a $17 per hour minimum wage, those who earn $41 per hour also would be exempt from garnishment, granting protections to debtors making north of $85,000 per year.

“This exemption is not need-based and would apply to all debtors based on individual pay, no-questions-asked,” says an opposition letter from a coalition of trade associations that includes the California Apartment Association.

When the Legislature instituted its COVID-19 eviction moratorium, lawmakers made clear that rental owners would be able to collect unpaid COVID rental debt through a civil court collections process and rent garnishment after two years. SB 1477 reneges on that promise.

The letter points out the unintended consequence of Wieckowski’s bill.

“If creditors are unable to recover on outstanding debts using the last option of wage garnishment, access to affordable credit will be further restricted for consumers who need it the most,” the letter says. “There is an enormous amount of academic research finding that legislation creating barriers to the legitimate collection of debt results in higher interest rates and less access to credit for low credit score consumers.”’

The legislation has already passed the state Senate and will be taken up by the Assembly next month when the Legislature returns from its summer recess.

State passes urgency COVID-19 eviction law 01/04/2022

A bill signed into law yesterday extends part of California’s COVID-19 eviction moratorium through June 30, but only for tenants whose applications for rental assistance have been submitted on or before today, March 31, 2022.

AB 2179 offers no protections for tenants who didn’t pay the rent and either refused to apply for rental assistance or were denied assistance based on income. Moreover, tenants who fail to pay rent that comes due Friday, April 1, and after are subject to eviction rules from before the pandemic.
