Temporary Protected Status (TPS) is a temporary immigration status provided to nationals of certain countries experiencing problems that make it difficult or unsafe for their nationals to be deported to those countries.

🔹To be eligible for this process, children under the age of 18 must be traveling to the United States in the care and custody of their parent or legal guardian. Under the Trafficking Victims Protection Reauthorization Act of 2008 (TVPRA), any child under the age of 18 who is not accompanied by their parent or legal guardian generally must be turned over to the Department of Health and Human Services (HHS) and vetted to protect against exploitation and abuse. Sponsors must be vetted before that child can be released and reunified. As a result, children traveling on their own, or with a non-parent or non-legal guardian adult, are not currently eligible for this process.

🔹From April 25, 2022, Ukrainian nationals who present at U.S. Southwest border land ports of entry without a valid visa or without pre-authorization to travel to the United States through Uniting for Ukraine may be denied entry and referred to apply through this process.

🔹When filing an initial TPS application, you must submit:

• Identity and Nationality Evidence: to demonstrate your identity and that you are a national of a country designated for TPS (or that you have no nationality and you last habitually resided in a country designated for TPS)

• Date of Entry Evidence: to demonstrate when you entered the United States

• Continuous Residence (CR) Evidence: to demonstrate that you have been in the United States since the CR date specified for your country (see your country’s TPS web page to the left)

🔹Any document that is not in English must be accompanied by a complete English translation. The translator must certify that:

• He or she is competent both in English and the foreign language used in the original document; and
• The translation is true and correct to the best of his or her ability, knowledge, and belief.

🔹Travel permits are available to people with TPS. It is known as advanced parole. It shows immigration officials that you are allowed to travel abroad and back to the USA.

🔹You can apply for a travel permit by filing Form I-131, Application for Travel Document. Follow the instructions on Federal Register notice when applying for a travel permit.

🔹You can apply for a work and travel permit at the same time or separately.

🔹In addition to Uniting for Ukraine, the United States is announcing a series of measures designed to expand access to existing legal pathways for Ukrainian citizens.

🔹The Department of State will expand U.S. Refugee Admissions Program (USRAP) operations in Europe to provide eligible Ukrainians with greater access to refugee resettlement processing under the Lautenberg program, while also expanding referral mechanisms for Ukrainians and others fleeing Russia’s war in Ukraine who are in need of permanent resettlement.

🔸Applying for Employment Authorization

🔹After you (the beneficiary) are paroled into the United States, you are eligible to apply for discretionary employment authorization from USCIS. To apply for discretionary employment authorization, you must submit Form I-765, Application for Employment Authorization, using the (c)(11) category code with the required fee or apply for a fee waiver.

🔸Eligibility for Uniting for Ukraine

🔹An individual who holds lawful status in the United States or is a parolee or beneficiary of deferred action or Deferred Enforced Departure (DED) who has passed security and background vetting and demonstrated sufficient financial resources to receive, maintain, and supports the individuals whom they commit to support for the duration of their stay in the United States.

🔹Examples of individuals who meet the SUPPORTER requirement include:
• U.S. citizens and nationals;
• Lawful permanent residents, lawful temporary residents, and conditional permanent residents;
• Nonimmigrants in lawful status (that is, who maintain the nonimmigrant status and have not violated any of the terms or conditions of the nonimmigrant status);
• Asylees, refugees, and parolees;
•TPS holders; and
• Beneficiaries of deferred action (including DACA) or Deferred Enforced Departure.

🔹Examples of individuals who meet the BENEFICIARY requirement include:
The Ukrainian citizen (or their non-Ukrainian immediate family member) who is outside the United States and who may be considered for parole under Uniting for Ukraine.
Immediate family members in this process include:
• The spouse or common-law partner of a Ukrainian citizen; and
• Their unmarried children under the age of 21. NOTE: If a child is under 18, they must be traveling with a parent or legal guardian in order to use this process.

🔹The United States strongly encourages Ukrainians seeking refuge in the United States who do not have and are not eligible for a visa to seek entry via Uniting for Ukraine from Europe, this will be the safest and most efficient way to pursue temporary refuge in the United States. The U.S. government is working with European partners to ensure Ukrainians can meet the vaccination requirements of Uniting for Ukraine.

🔹Ukrainians should not travel to Mexico to pursue entry into the United States. Following the launch of Uniting for Ukraine, Ukrainians who present at land U.S. ports of entry without a valid visa or without pre-authorization to travel to the United States through Uniting for Ukraine will be denied entry and referred to apply through this program.

🔹Uniting for Ukraine is a streamlined process for Ukrainian citizens who have been displaced by Russia’s aggression to apply for humanitarian parole in the United States.
🔹To be eligible, Ukrainians must have been residents in Ukraine as of February 11, 2022, have a sponsor in the United States, complete vaccinations and other public health requirements, and pass rigorous biometric and biographic screening and vetting security checks.
🔹Ukrainians approved via this process will be authorized to travel to the United States and be considered for parole, on a case-by-case basis, for a period of up to two years. Once paroled through this process, Ukrainians will be eligible for work authorization.

🔹As of April 21, 2022, the President announced Uniting for Ukraine, a new streamlined process to provide Ukrainian citizens who have fled Russia’s unprovoked war of aggression opportunities to come to the United States, fulfilling President Biden’s commitment to welcome up to 100,000 Ukrainians and others fleeing Russia’s aggression as a result of the ongoing Russia-Ukraine crisis. In addition, the State Department is announcing increased refugee resettlement processing and broadened access to visa processing at consular posts overseas. This builds on the robust humanitarian assistance the U.S. government is providing to complement the efforts of generous countries throughout Europe who are hosting Ukrainian citizens who have been displaced.

🔹The Department of Homeland Security (DHS) announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months. This designation can be extended at the discretion of the Secretary of Homeland Security. If the designation is “redesignated,” anyone from the country who came to the United States after the original designation may apply for the protections. If a country’s designation is extended, the status of those people who currently hold TPS is extended until the new extension date.

🔸Be a national, or a habitually stateless resident of a country with TPS;
🔸Reside in the United States since March 1st, 2022;

🔹On Thursday, March 3, 2022, Homeland Security announced a new Temporary Protected Status (TPS) designation for Ukraine for 18 months. The decision was made in response to Russia’s premeditated and unprovoked attack on Ukraine, which prevents Ukrainian nationals, and those of no nationality who last habitually resided in Ukraine, from returning to the country safely.

🔹This new designation enables Ukrainian nationals and individuals without nationality who last habitually resided in Ukraine, who currently live in the United States, to file initial applications for TPS.

🔹TPS holders are eligible for an employment authorization document (EAD), and eligible for travel authorization.

🔹On March 3, 2022, the Department of Homeland Security (DHS) announced that Ukraine will be designated for Temporary Protected Status (TPS) for 18 months. TPS is available for those Ukrainian nationals who are already in the U.S. and have been since March 1, 2022.
