This week of the nurse May 6-12th I am asking all nurses who may have leads to help.
In response to one troll/guy who said’ “You just want to become rich…” I responded, “ I have lost 4 friends who were my mentors to this devastating cancer.
I donate over 200 hours a year to pro bono / free and voluntary service on television and radio.
I pay thousands to help people who do not have a voice. Thanks to Carlos Ktmv Lopez Broadcasting and Texas’ CBS and NBC , I am going to reach millions of women who may have lost a mom, sister, aunt or best friend to what we as nurses was taught was a safe measure.

I realize that reasonable medical minds differ but as a nurse practitioner and a trial lawyer I have chosen the side I am on. Period.
Please help in our fight against stopping ovarian cancer in women that are dying as early as their 20’s and 30’s. Our research by physician and epidemiology colleagues is strongly correlating a connection between what we thought was harmless baby powder for half a century or more to deadly and aggressive cancer. As a young nurse’s aide I administered the powder to prevent chafing and discomfort as did many nurses. I carry that with me every day.

Quick Medical-Legal Minute( not legal advice to be relied upon for a specific case or to create a legal contract with any specific individual)
If I am reported to the Board or face a threatened complaint what should I do? An ounce of prevention. Always carry affordable insurance like NSO or Mercer and many more options are out there. Shop around. Do not discuss with anyone but an attorney.
If I receive a letter from the board? Never answer the letter first. You must ask for the Board’s complete file in writing. Inform them you are seeking legal counsel and cannot answer allegations without the complete file including the board investigators report. You need at least 30-60 days to respomd after receiving the complete file. Consult the attorney of your choice thereafter immediately or contemporaneously with this request.
If I receive the file from the board but it is missing a great deal of key information what should I do? Ask the board to enforce subpoena powers and itemize specifically what you see is missing. They will then either serve the subpoena on the complainant, employer or other source and serve it directly or empower you and your lawyer to do so.
What if the board is strongarming you and sends you a take it or leave aka a “dropdead letter” suggesting you take a punishment for something you did not do? Directly send it to your attorney. Cease all communications without your lawyer responding for you. Make sure your lawyer has extensive experience in administrative law and board cases.
What are alternatives to dropdead letters? Through your attorney you can ask for an informal conference or mediation where you get to explain your side of the story, supplement your case with letters from patients ( initials only) and from colleagues, former professors, clergy or persons that are influential in politics or health care that know you. Include pictures of you as a new nurse, and throughout your career while blurring or blacking out identifiers of a specific patient.
Summary
I have had cases that seemed hopeless: From alleged crimes to drug and alcohol abuse allegations to failure to document there is always something new. A good lawyer listens as does a good client. Remember to never go it alone.
An experienced lawyer with the board is invaluable. Prices vary but insurance may help to defer a great deal of cost. Nurses can make the mistake of ignoring or minimizing the complaints (“ I didn’t do anything wrong”) to the “ sky if falling” reaction. Both sides of the spectrum are not the solution. Any money spent in retaining a well-trained lawyer is worth it in comparison to what you stand to lose: a 1-3 million dollar career on avg over a lifetime plus your good name which is invaluable.

A hard fought battle to reinstate a highly decorated ER physician’s license and we did it using focus groups, a mock administrative law hearing, role reversal/psychodrama and with much preparation. Thanks to my friend and colleague Robert for his help on my client’s case. The odds were deeply stacked against us.
The physician stated afterward that he was not only grateful for our advocacy but he also learned so much about himself, his practice and his future goals as a frontline provider fighting the good fight against Covid19! His story moved the hearts of the panel to a very positive result!
