Have you heard about the National Association of Realtors (NAR) lawsuit and upcoming changes to real estate? We all know the dangers of the telephone game, so let's clear the air from start to finish. Here are the two main take aways:
Starting July 1st, it will be Iowa state law for all buyers working with a real estate agent on a sales transaction (residential or commercial) to have a Buyer's Agreement with a Realtor® before touring a property. This agreement is a contract between a buyer and a real estate agent that establishes their working relationship. It clarifies whether the agent represents the buyer exclusively or in another capacity, specifies the duration of the agreement, outlines how the agent will be compensated, details the services provided, includes terms for termination, and ensures legal and ethical responsibilities are met. This agreement protects both parties and ensures clear expectations during the home buying process.
Starting August 17th, NAR's new rule will prohibit offers of compensation from being visible on the MLS. This means the buyer's real estate agent compensation for their professional services can be included as a negotiable term in the purchase contract. Overall, these changes aim to create a more transparent real estate market by making the costs associated with buying and selling a home clearer to all parties involved by disclosing the allocation of selling and buying expenses.
