Louisiana Department of Insurance Urges Homeowners to Prepare Now for Hurricane Season

Insurance Commissioner Jim Donelon is advising residents across Louisiana to prepare and remain vigilant as hurricane season began June 1 and has already shown high activity with the forming of tropical storms Arlene and Bret.
Researchers at Colorado State University forecast 2023 to be a near-average hurricane season with 14 named storms, including seven hurricanes and three major hurricanes. They predict a 43% chance for at least one major hurricane to make landfall in the United States and 27% chance for the Gulf Coast.
"I understand many homeowners are nervously facing this hurricane season while still trying to secure a policy in the private market," said Commissioner Donelon. "The Insure Louisiana Incentive Program is underway, and I encourage homeowners to continue to reach out to agents to place a policy as soon as possible."
Homeowners, business and flood insurance policies are the most effective ways to safeguard your property from hurricanes. It is crucial to act now as most property insurers stop writing policies when a storm enters the Gulf of Mexico.
The LDI recommends following these four steps to prepare for hurricane season:
Get flood insurance. Flood damage resulting from heavy rain or storm surge is not a covered peril in standard homeowners policies, and there is typically a 30-day waiting period before a flood insurance policy takes effect. For information on a subsidized National Flood Insurance Program (NFIP) policy, contact an agent or visit www.floodsmart.gov.
Review your insurance coverages. Named storm and hurricane deductibles typically run 2% to 5% of the insured property value. If a home has an insured value of $200,000 with a 5% hurricane deductible, the policyholder will pay $10,000 out of pocket before insurance coverage takes effect after a named storm. Details of these deductibles are listed on the declarations page of your policy.
Update your home inventory. You can use your phone to take pictures or video of the items in your home. Having a record of your possessions will make the claims process easier in the event of property damage or loss. Include identifying information such as brand name and serial number. The NAIC Home Inventory App makes it easy for you to create a record of your belongings. The app allows users to upload and export photos, find disaster preparation advice and review information about filing a claim. The NAIC Home Inventory App is available for download in the App Store and Google Play.
Make an evacuation plan. Have copies of your policies, as well as your agent and insurance company’s contact information, ready to go in case of an emergency evacuation. This will enable you to start the claims process as soon as possible if your home is damaged in the storm.

Louisiana Department of Insurance Approves Citizens Rate Increase and Offers Tips for Policyholders
The Louisiana Department of Insurance (LDI) has approved Louisiana Citizens’ request for a 63% rate increase on its residential property insurance policies beginning January 1, 2023. The rate increase will not affect Citizens’ current policyholders until they renew their policy after that date.
Citizens is the state’s insurer of last resort. Louisiana law requires Citizens’ rate for each of its policy types in each parish to be at least 10% over the highest qualifying market rate or 10% over the actuarial rate, whichever is higher.
The rate increase is almost totally a result of the increased cost of reinsurance for Citizens’ increased number of policies this hurricane season. The best way to reduce the burden of this and future Citizens rate increases is the Insure Louisiana Incentive Program, which is awaiting funding from the legislature.
"There’s no sugarcoating it — this increase is extremely painful but required by law to make sure Citizens can handle a potential future disaster for its many policyholders," said Commissioner Jim Donelon. "My staff and I are working with the legislature to attract more insurers to the state through the use of a program that was highly effective following hurricanes Katrina and Rita, which will give Citizens policyholders, and all Louisianans, more and cheaper insurance options in the private market."
Citizens policyholders should be aware of the following:
The rate increase will not affect your policy until renewal. For example, if you get a Citizens policy on November 1, 2022, your premium will be unaffected through October 31, 2023.
Citizens policyholders should contact multiple independent insurance agents at least monthly to request quotes from private insurers.
The LDI expects the number of insurers writing policies to increase in the coming months. Citizens will refund your unearned premium if you find a policy with another insurer before the end of your Citizens policy term.

Workers’ Compensation Rates Down by Double Digits in 2022
Louisiana Insurance Commissioner Jim Donelon has approved the annual loss cost filing of the National Council on Compensation Insurance (NCCI) for a -10.5% reduction in workers’ compensation rates. The decrease will take effect May 1, 2022.
This year’s filing continues the downward trend of eight of the last nine years, including the upcoming 2022 rate decrease. Workers’ compensation rates have fallen dramatically over the past two decades. They have had a cumulative drop of -25% over the last five years, -38% over the last ten years, and -57% over the past 20 years.
"Workers’ compensation rates have been a great success story in our market," said Commissioner Donelon. "We’ve seen a strong downward trajectory in rates over the past two decades, including this year’s double-digit decrease. Our workers’ compensation market is thriving, and that’s great news for Louisiana employers."
The mission of the National Council on Compensation Insurance (NCCI), which was founded in 1923, is to foster a healthy workers’ compensation system. In support of this mission, NCCI gathers data, analyzes industry trends, and provides objective insurance rate and loss cost recommendations to its 35 member states and the District of Columbia. NCCI members can adopt the approved rate or they can include NCCI’s analysis with their own loss experience to complete their own rate filing with the Louisiana Department of Insurance (LDI).
The total Louisiana workers’ compensation insurance market in 2021 is estimated to have about $850 million in written premium. Louisiana has a record 249 companies writing workers’ compensation insurance, creating a very competitive market.

Commissioner Donelon Reports 2020 Hurricane Data, Including Zeta
Insurers have paid or reserved $7.7 billion on claims of all types in Louisiana through the end of 2020 from hurricanes Laura, Delta and Zeta, Insurance Commissioner Jim Donelon announced today. This data represents the first measure of damage from all three hurricanes that struck the state in the record 2020 storm season.
Policyholders filed 290,847 claims of all types from the three storms as of December 31. Of those, 161,704 claims, or 56%, were closed with payment as of December 31, garnering $5 billion in payments for damage caused by the three hurricane events.
"After a record storm season that tested the state multiple times, paid claims represent a way forward for those most affected by these hurricanes," said Commissioner Donelon. "This is $7.7 billion owed to Louisiana policyholders to rebuild their lives, homes and businesses. Furthermore, it’s billions of dollars that didn’t come from taxpayers in a time when municipal budgets are reeling from the events of the last year."
The information was generated from a data call to all authorized property and casualty insurers, including surplus lines insurers, to submit their claims data on hurricanes Laura, Delta and Zeta. The figures include claims from personal and commercial insurance. They do not include claims or payments from the National Flood Insurance Program, which is not regulated by the Louisiana Department of Insurance.
The data call figures released today represent the most comprehensive look to date of insured losses in Louisiana from the record 2020 hurricane season.
Policyholders have filed 169,891 claims from Hurricane Laura, which struck Southwest Louisiana on August 27 as a Category 4 storm. Calcasieu, Rapides, Beauregard, Ouachita and Vernon parishes had the most claims from the storm.
As of Dec. 31, 2020, insurers had closed 77% of the claims from Hurricane Laura, 59% of which were closed with payment. Total paid losses plus reserves on reported claims from all surveyed lines of insurance for Hurricane Laura at the end of 2020 were $6.6 billion, accounting for the vast majority of damage from the record 2020 hurricane season in Louisiana.
Policyholders have filed 71,945 claims from Hurricane Delta, which made landfall in Southwest Louisiana on October 9 as a Category 2 storm. Calcasieu, Lafayette, Acadia, East Baton Rouge and St. Landry parishes filed the most claims from the storm.
At the end of 2020, insurers had closed 82% of all Delta claims, and 53% of those claims were closed with payment. Insurers have paid or reserved $556 million to cover losses from reported claims from all surveyed lines of insurance for Hurricane Delta at the end of 2020.
The data call results also included the first claim figures from Hurricane Zeta, which made landfall in Terrebonne Parish on October 28 as a Category 2 storm. Policyholders have filed 49,011 claims through the end of the year. Most of the claims came from Jefferson, Orleans, St. Bernard, St. Tammany and Lafourche parishes.
Insurers closed 79% of reported Zeta claims, and 46% of those claims were closed with payment. Total paid losses plus reserves on reported claims from all surveyed lines of insurance were $499 million for Hurricane Zeta at the end of 2020.

The LDI will continue to collect data from property and casualty insurers to monitor the claims process. The final deadline for data is Oct. 8, 2021.

Donelon Approves Fourth Consecutive Auto Rate Decrease for State Farm / $202 Million in COVID-19 Premium Returned to Louisiana Policyholders
Louisiana Insurance Commissioner Jim Donelon announces his approval of a permanent decrease of 9.6% in the rate for auto insurance policies issued by State Farm Insurance Company for Louisiana drivers. This auto insurance reduction by State Farm, follows approved decreases of 4.5% in 2018, 6.5% in 2019 and 2.3% in March of 2020, which total a 23% decrease in the last two years.
"State Farm provides auto insurance for more than a million Louisiana policyholders and has been at the forefront of giving consumers relief from their auto premiums due to decreased driving during the COVID pandemic," said Commissioner Donelon. "We’ve seen many other local and national insurers do the same since the issuance of nationwide stay at home orders that have resulted in Louisiana policyholders receiving over $202 million dollars in rebates or refunds."
Additionally, Louisiana’s private passenger auto insurers continue to return auto premium to Louisiana drivers as a response to emergency declarations and stay at home orders in place throughout the U.S. and Louisiana. Insurers are seeing significantly fewer miles driven, resulting in a reduction in the frequency of accidents and claims filing, as well as ultimate lawsuits being filed.
At the time of publication, the insurers below have announced or provided the Louisiana Department of Insurance (LDI) with the details of a rebate or rate reduction program and these insurers provide coverage to 97% of Louisiana’s insured drivers.
The effective date of State Farm’s current reduction is August 24, 2020 for new and renewal policies. If policyholders have any questions about rebates or refunds, they should contact the Louisiana Department of Insurance at 1-800-259-5300 or by visiting www.ldi.la.gov.
