Gibson Law Office is taking all practical measures to keep our clients, staff, and members of the community safe during the coronavirus pandemic.

If you are sick or have symptoms of illness; have been in recent contact with anyone who has a fever; have traveled outside of the United States in the past 14 days, or are over 60 years of age, please notify our office prior to appearing in Court. If any of the above are true, we will file a motion to continue your hearing.

You should not bring family or friends to the Courthouse, unless the person is a witness who will testify. If you require transportation, the driver should wait outside. After appearing at any court proceeding, you should wash your hands with soap and water.

You should attempt to minimize contact with others in the Courthouse and dispense with shaking hands or making other direct contact. Please notify us immediately if you have any health concerns regarding appearing in Court.

New clients often tell us that they are surprised that police didn’t read them Miranda Warnings. Almost everyone is familiar with the Miranda Warning, which is often read when someone is arrested but isn’t required in every situation. Criminal cases begin with an allegation or suspicion that someone has committed a crime. When police have reasonable suspicion that a crime has been committed, they can make an investigatory traffic stop, or seek to interview possible witnesses or suspects, without reading the Miranda Warning. Police are trained to interrogate people to obtain evidence. During the initial investigation, anything that you say can be used against you later at trial. If you are a suspect in a crime, you should exercise your right to remain silent and your right to an attorney.

Indiana has a new law that allows persons subject to a protective order that has been dismissed or denied to expunge the records of the protective order. Protective orders are searchable in law enforcement databases as well as on the public protective order registry, which could subject you to questions from employers, even when a protective order has been dismissed.
