Both AILA NJ and AFGE Local 511 (ICE Professionals Union) call on the Newark Immigration Court, part of the U.S. Department of Justice, Executive Office for
Immigration Review (EOIR), to continue to allow virtual hearings for all attorneys and immigrants, in all cases, without exception. These attorneys are opposed to the recentlyannounced policy of the Newark Immigration Court requiring all attorneys to either return in person to hearings beginning on October 3, 2022 or to seek waiver of in-person appearance for good cause. Public safety requires virtual hearings, especially for routine preliminary hearings that generate large groups of people in small courtrooms.

Due to a possible COVID-19 exposure, the Elizabeth Immigration Court will be closed tomorrow, Dec. 8, for cleaning, consistent with CDC guidelines. Any known close contacts have been notified. Please monitor EOIR’s website for information about the agency’s operations nationwide.

Practice Alert: District Court Orders Full Reinstatement of DACA

December 4, 2020
On December 4, 2020, a U.S. District Court for the Eastern District of New York ordered DHS to fully reinstate the DACA program, finding that Wolf’s July 2020 memo reconsidering the DACA program must be put aside. The order is effective immediately, and DHS is required by the order to post a public notice stating that it is accepting new, initial DACA applications, work permits are valid for two years, and DACA recipients are eligible to apply for Advance Parole.

The court had previously held in a November 14, 2020, decision that Chad Wolf was not lawfully serving as DHS Acting Secretary under the Homeland Security Act when he issued the July 28, 2020, memorandum suspending DACA following the Supreme Court decision in DHS v. Regents of the University of California.

UPDATE: The Haitian Bridge Alliance, the Institute for Justice & Democracy in Haiti, and immigration scholars Ira Kurzban and Irwin Stotzky filed an amicus brief in Al Otro Lado v. Wolf, a case litigated by the American Immigration Council, the Southern Poverty Law Center, the Center for Constitutional Rights, and Mayer Brown LLP challenging the government’s policy of turning back asylum seekers at the U.S.-Mexico border, a policy that originated with the turning back of Haitian migrants in Tijuana in 2016.

On November 12, the Council, AILA, and legal service providers filed an amicus brief in Pham v. Guzman Chavez urging the Supreme Court to find that detained noncitizens with prior removal orders who have meritorious claims for a form of humanitarian protection known as withholding of removal are entitled to bond hearings. The brief argues that subjecting such individuals to mandatory detention violates our international human rights commitments. The brief also lifts up stories of individuals who have gone through withholding-only proceedings and highlights the lengthy time periods they spent in detention and the impact of that detention.

Council Files Amicus Brief on Opportunity for Detained Migrants with Prior Removal Orders Seeking Humanitarian Protection to be Released on Bond The amicus brief in Pham v. Guzman Chavez urges the Supreme Court to find that the pre-final order detention statute applies to detained noncitizens with prior removal orders who have meritorious claims for a form of humanitarian protection known as withholding of removal.

On November 4, the District Court for the Western District of Washington approved a final settlement agreement in Mendez Rojas v. Wolf, a class-action lawsuit challenging the government’s failure to notify asylum seekers of the one-year filing deadline for asylum applications and to provide a mechanism that would allow asylum seekers to timely file their applications. The text of the final settlement agreement and sample templates for asserting class membership under the settlement may be found here. More information about how the government is implementing the final settlement agreement may be found here. On November 20, the Council’s Karolina (Caroline) Walters provided the AILA Nevada Chapter a CLE on the Mendez Rojas final settlement agreement.

AILA-NJ v. EOIR Newark Immigration Court

AILA-NJ has achieved its goal of making remote televideo appearances available to all parties. In a court hearing yesterday before the Honorable John Michael Vasquez, the Newark Immigration Court Chief Immigration Judge certified that these remote video hearings are ready and available (by motion) to attorneys, their clients and all stakeholders.

As plaintiffs, AILA-NJ maintained this was not merely legally required, but also feasible and safe; the Newark Immigration Court responded to our complaint by implementing WebEx hearings within two weeks’ time. The Newark Immigration court resumed in-person immigration removal proceedings on July 13, 2020 without providing for remote video appearances or other safety measures against COVID-19; this was the driver for our litigation. Honorable John Michael Vazquez indicated that he took seriously the Newark Immigration Court’s representations that it will continue to provide this remote video option, and we hope that any opinion he issues recognizes the importance of the Newark Immigration Court’s continued commitment to providing remote video hearings to immigration attorneys and their clients to allow for safe removal proceedings for all parties involved.

The Newark Immigration court is now operating at the same standards of every other court throughout the state. In these difficult times, AILA-NJ’s litigation fought to guarantee due process in the immigration court, allow for zealous representation of our clients, and to protect the health of all parties involved. AILA-NJ is proud of the result in this case: we have ensured that people's health and safety are being protected, and that Newark Immigration Court will now be offering safe court proceedings. We hope that EOIR will utilize the same technology in its courts throughout the country. Our Chapter is happy to celebrate this as a win.
