The failure of the caregiver bill was reckless with patient healthcare. The House Finance committee has offered no explanation as to why they allowed it to fail.

There remains no requirement to label ingredients or provide the medicinal compounds required to treat specific treatments allowed by the program. They call it a medical program but the treatment options are minimal for patients trying to treat specific, cannabis treatable diseases.

We have a lot to celebrate. In the past year, more states have fully legalized cannabis and implemented laws to reduce or eliminate cannabis-related criminal sentences and convictions. Even President Biden has acknowledged the failed approach of federal cannabis prohibition, and his recent actions to issue additional mass pardons show that the momentum is building for comprehensive federal reform.
But there is still much work to be done. Last year, we released our State of Cannabis Justice Report, which shows just how far each state needs to go to truly achieve cannabis justice. At the federal level, we must keep pushing for full legalization of cannabis and to release all federal cannabis prisoners. That’s why this week we are on the ground in DC organizing our 4/20 Unity Day of Action with cannabis advocates from across the country.

From the time she was an infant, she suffered from frequent and severe seizures because of Dravet syndrome, a rare and potentially life-threatening genetic disease that causes unrelenting epilepsy in children and adults. The Figis tried numerous medications to quell Charlotte’s seizures, but none worked.
Then, at age 5, Figi gave her cannabidiol, a non-psychoactive compound in cannabis, and Charlotte’s condition changed overnight. Her seizures became less frequent. She began speaking again after months of silence.

A BILL FOR AN ACT
RELATING TO MEDICAL CANNABIS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that existing state law recognizes the beneficial use of cannabis in treating certain debilitating medical conditions, their symptoms, and certain side effects of treatment for these conditions, including severe pain, nausea, muscle spasms, and seizures. Act 241, Session Laws of Hawaii 2015, provided patient access to medical cannabis beyond the access that existed before the creation of the dispensary system authorized by the Act. However, the intent of the legislature as expressed in that Act was, and continues to be, to expand qualifying patient's access to cannabis rather than to replace existing legal access routes. According to the rapid survey of Hawaii medical cannabis patients and providers conducted by the department of health in 2022, fifty-five per cent of patients indicated that they obtained their cannabis exclusively from a licensed medical cannabis dispensary. This means that up to forty-five per cent of patients obtain their cannabis for medical use from other sources, including home cultivation. Part of the justification for establishing the medical cannabis dispensary system was that some patients may not be able to grow their own supply of medical cannabis due to limitations such as disability or lack of space. These patients should continue to have multiple options for obtaining medical cannabis, including having a primary caregiver grow an adequate supply of cannabis for medical use on their behalf.
Accordingly, the purpose of this Act is to repeal the sunset date of the authorization for primary caregivers to cultivate medical cannabis for qualifying patients and clarify that primary caregivers may continue to cultivate medical cannabis for qualifying patients subject to certain restrictions.
SECTION 2. Section 329-130, Hawaii Revised Statutes, is amended to read as follows:
"§329-130 Authorized sources of medical cannabis. (a) [After December 31, 2024, a] A qualifying patient shall obtain medical cannabis or manufactured cannabis products only:
(1) From a dispensary licensed pursuant to chapter 329D; provided that the cannabis shall be purchased and paid for at the time of purchase; [or]
(2) By cultivating cannabis in an amount that does not exceed an adequate supply for the qualifying patient, pursuant to section 329-122; provided that each location used to cultivate cannabis shall be used by no more than five qualifying patients[.]; or
(3) From the qualifying patient's primary caregiver who cultivates cannabis in an amount that does not exceed an adequate supply for the qualifying patient pursuant to section 329-122; provided that each location used to cultivate cannabis shall be used to cultivate cannabis for no more than five qualifying patients.
[After December 31, 2024, no primary caregiver shall be authorized to cultivate cannabis for any qualifying patient.
(b) This section shall not apply to:
(1) A qualifying patient who is a minor or an adult lacking legal capacity and the primary caregiver is the parent, guardian, or person having legal custody of a qualifying patient described in this paragraph; or
(2) A qualifying patient on any island on which there is no medical cannabis dispensary licensed pursuant to chapter 329D.
(c)] (b) A qualifying out-of-state patient and a caregiver of a qualifying out-of-state patient shall be authorized to obtain cannabis for medical use only from retail dispensing locations of dispensaries licensed pursuant to chapter 329D."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 3000.

Our bottom line:
Wait for the federal exemption for patients in Hawaii. Try wait until cannabis has been removed from the federal Controlled Substances Act entirely, before moving ahead with recreational use in Hawaii, and in the meantime improve and expand the medical program, to include getting a federal exemption for our patients.

Unfortunately, I couldn't access the video for specific comments by the governor due to restrictions, but the importance of their perspective on this issue cannot be overstated. Their insights likely emphasize the necessity of this relationship in navigating the medical use of cannabis and the broader implications for patient care within the state.
With this in mind, the bottom line is clear: Patients should wait until cannabis has been removed from the federal Controlled Substances Act entirely before Hawaii proceeds with recreational use. In the meantime, efforts should focus on improving and expanding the medical program to secure a federal exemption for our most vulnerable populations. This approach ensures that no parent faces uncertainty over whether the cannabis-based medicine they purchase will benefit their child or elderly family member. The ultimate goal is to create a medical cannabis environment where clarity, safety, and patient well-being are paramount.

Recently, both President Biden and Vice President Harris have been touting their administration’s cannabis pardons as fulfilling the promise he made on the campaign trail in 2020. However, the cannabis pardons he has granted have not released anyone from prison nor have they expunged any records as a federal expungement mechanism doesn’t exist.

2024 Hawaii Recreational Cannabis Bill Introduced by Attorney General Lopez (DRAFT)
Purpose: Establish the Hawaii cannabis law and authority, regulate cultivation, manufacture, sale, and personal adult use of cannabis, establish taxes, and legalize possession of certain amounts for adults over 21 from January 1, 2026.
Scope: Covers medical cannabis, adult-use cannabis, and h**p, with different regulations for each category.
Definitions and Terms
Adequate Supply: Defined as four ounces of cannabis at any given time, including a combination of cannabis flower and products.
Cannabis Cultivator: A person licensed to cultivate cannabis.
Cannabis Plant: Defined as the Cannabis genus plant in various growth stages, excluding germinated seeds, cuttings, or clones without observable roots and leaves.
Cannabis Processor: Person licensed to process cannabis.
Craft Cannabis Dispensary: Licensed operation for craft cannabis.
Edible Cannabis Product: A cannabis product intended for oral human consumption.
Medical Use: Involves acquisition, possession, cultivation, use, or transportation of cannabis for alleviating symptoms of a medical condition.
Plant Canopy: Refers to the area dedicated to live plant production, excluding storage and office spaces.
Licensing and Regulation
Licensing Procedure: Includes randomized lottery selection and background checks.
Fees and Qualifications: Schedule of fees relative to business volume, qualifications for licensure, and promotion of participation from disadvantaged communities.
Training and Insurance: Requirement for employee training and liability insurance coverage or security against liabilities.
Health and Safety Standards: In consultation with the health and agriculture departments, covering cultivation, processing, distribution, and dispensing.
Labeling and Environmental Standards: Requirements for packaging labeling, energy, and environmental standards.
Operational Guidelines
Premises Standards: Guidelines on construction, arrangement, and operation of licensed premises.
Product Restrictions: Prohibitions on synthetic or artificially derived cannabinoids in cannabis products.

This was scores of residents, led mostly by Native Hawaiians, who had battled immense grief and unreliable communications to coordinate a large-scale disaster relief effort serving everyone in need after Tuesday’s ruinous Maui fire.
“There’s no government agency helping us — this is it,” said Jareth Lumlung, a Native Hawaiian who helped arrange the de facto donation hub. “This is our home, our community.”
For people whose cultural traditions have been threatened by American colonization and the state’s embrace of tourism and development, government help was never expected. Instead, the community has relied on itself.”
