FOUR THINGS A TRUST CAN DO THAT A WILL CANNOT:

#1 - Act as a Disability Plan -

A revocable trust serves as protection from the get go while the trust maker is alive and well, through any incapacity, and after death. A will is only effective for distributing property after death.

#2 - Keep Assets Outside of Probate -

Probate costs time and money at a time your loved ones will grieve. A trust-based plan eliminates the need for court involvement and oversight, as required for a will.

#3 - Keep a Minor’s Inheritance Outside of Guardianship - A minor beneficiary of a life insurance policy or IRA will require a court-appointed guardian to manage the property until the minor turns 18. A trust can receive the same inheritance for a minor and avoid court appointment and determine how long the trust will continue - to age 18, 25, 50, or beyond!

#4 - Keep Final Wishes Private - A will becomes public record in the probate process because court proceedings are open, which means anyone, including predators and your competitors, can read wills and other probate filings, like asset inventories. A trust, however, is a private document that remains confidential during life and after death, keeping your asset and inheritance information private.
