Is SKKN by Kim or SKKN+ too similar or is the big guy trying to trample the little guy?

Kim Kardashian recently filed for a trademark for “SKKN by Kim” and has been accused of trademark infringement because of an earlier-filed trademark application for “SKNN+”. These two marks clearly have similarities and offer the same beauty products, however, there are slight variations in the two marks that might be enough for both marks to co-exist. By filing the trademark application for “SKNN+”, the owner of Beauty Concepts, LLC, Cyndie Lunsford, benefited from the protection provided by the USPTO which blocked “SKKN by Kim’s” application. One of the biggest benefits of registering your brand is to know that your brand is protected from other similar trademarks being registered. Now “SKKN by Kim” has been forced to oppose the application with the USPTO.

One issue here is if the “SKNN by Kim” brand is allowed to register, then Cyndie’s “SKNN+” brand may potentially be overshadowed by the famous and well-known owner Kim Kardashian and lose any traction she has made with her brand awareness and possibly be put out of business. The great thing about having a registered trademark is that every business can be protected from larger businesses or famous owners trying to overshadow one’s brand because of their celebrity status. Because the “SKNN+” brand sought registration early they have a chance to exclude the more famous owner of the “SKNN by Kim” trademark or at the very least carve-out ways for both brands to co-exist. This case will be interesting to see how it is resolved.
