Believe it or not, one of the top 10 COBRA oversights is employers simply not realizing they must comply with Federal COBRA regulations. Understanding these facts about COBRA will keep you out of a courtroom, and prevent employers from paying hefty fines and penalties. Not to mention, it'll ensure your employees' rights are honored by offering the correct benefit options when the time comes.
Happy Independence Day from all of us at CobraHelp! Enjoy your freedom celebrations and stay safe out there!
Did you know that certain types of qualifying events allow your eligible employees to have a specific number of months on COBRA should they choose to elect?
For example, termination of employment events give qualified beneficiaries 18 months in most cases, while dependent spouses who experience a divorce event will be allotted a total of 36 months of COBRA.
With mid-year group health plan renewals underway during June and July, don't forget about COBRA qualified beneficiaries! Both notified and enrolled COBRA participants must be offered the same open enrollment opportunities as active insured employees! Employers be sure to keep qualified beneficiaries apprised of plan changes, rate changes, and allow them to add dependents during this time. COBRA premiums are typically those which are provided by your carrier or your self-funded plan. Keep in mind there are circumstances when the employer will need to calculate premiums such as when an HRA (Health Reimbursement Arrangement) is in effect. Yes, COBRA qualified beneficiaries are also eligible for these kinds of benefits! It is best practice for an employer to have an actuarial service calculate these rates for the current year if unknown using a special formula. Myth buster: this tip of the month shows us that employers must understand whether their plans are subject to Federal COBRA or not. Yes, even many self-funded plans MUST comply with Federal COBRA regulations. Stay out of the courtroom by training your HR team to know which plans mean COBRA continuation for your employees.
