$100K Halloween Settlement —
Read more to learn how Attorney Trey Ennis successfully negotiated a $100,000.00 settlement by “morphing” the client’s insurance policy from a $50K coverage limit to $100K coverage limit.

The client was injured after being hit by a group of teenagers in a stolen vehicle during a police chase. Because the vehicle was stolen and the unknown driver fled the scene after impact, there was no liability coverage. The $100,000.00 settlement was negotiated with the client’s uninsured motorist (“UM”) carrier.

The default rule in Georgia is that a person’s UM coverage limit must be equal to the person’s liability coverage limit unless the insured affirmatively elects UM coverage in a lesser amount. O.C.G.A. 33-7-11.

In this case, the client’s insurance policy seemed to show a liability coverage limit of $100K with a UM coverage limit of only $50K. This $50K difference in coverage immediately triggered an insurance investigation by Attorney Trey Ennis to make sure the insurance company had evidence that the client affirmatively elected the lesser amount.

Eventually, the insurance company admitted that they had no evidence that the client affirmatively elected UM coverage in a lesser amount and conceded that the legal coverage limit was $100K (not $50K).

Despite agreeing to the $100K coverage limit, the insurance company initially offered $36K based on the client having approximately $15K in medical bills. Attorney Trey Ennis rejected the initial offer of $36K on behalf of the client but allowed the insurance company a second opportunity to accept the $100,000.00 demand without penalty under O.C.G.A. 33-7-11 (j). Ultimately, the insurance company accepted and timely paid the reiterated demand of $100,000.00.

Trey handled the same legal issue as defense counsel for GEICO alongside Wallace Miller in 2017 in a case closely watched by the insurance industry. GEICO v. Morgan, 341 Ga. App. 396, cert. denied (2017). Five years later, Trey’s turning defense to offense by using the Morgan case for the people to the tune of $100,000.00.

The insurance company called the client the day after the accident and offered $2,500. Luckily, the client declined the offer and called Attorney Trey Ennis.

The result? Proper medical care and a $140,000.00 pre-suit settlement at mediation based on $60K in medical bills.

This was the 2nd largest injury settlement ever reported in Jones County, according to data from CaseMetrix.

So what do you do with this information? When the clients first reported the accident to their insurance agent, the agent said there was no available UM coverage ($0).

The clients then hired Attorney Trey Ennis. Trey conducted a legal insurance investigation that revealed the clients actually had a total of three (3) UM policies that “stacked” to create $50K in UM coverage per client, not $0.

The cases would resolve shortly thereafter for the combined amount of $101,000.00 without litigation. The clients’ combined medical bills were right at $29K.

However, if the clients would have listened to the insurance agent and not hired .legal , their insurance agent would have cost the clients over $50K 🤯

So what do you do with this information:

(1) Call your auto insurance agent today to make sure you DO NOT HAVE “Reduced-by” UM coverage in GA - make sure you have “Add-on” UM coverage.

(2) If you’re involved in an accident and your insurance agent hesitates in any way to refer you to a personal injury attorney, fire your insurance agent immediately and get one that puts you first.
