ANALYSIS:
We will be attacking the credibility of what all these posts purport to be proving
1. We will assume this picture is not edited, but the possibility that it was framed to smear the police remains. This scenario is possible: protester accidentally slingshots victim > victim or protesters around her immediately throw out slingshot projectile and replace it with a bean bag round
2. Saying the victim said something in a dream is unreliable and may suggest fear of legal liability (libel) if the “dream” was found to not be true
3. We will assume this video is unedited, but the possibility that a bean bag caused the injury remains. This scenario is possible: at the same time the tear gas was fired, a bean bag round was fired too. Another possibility is that the reporter mislabelled what was fired on live television. As for the bus stop advertisement being a barrier, the possibility remains that the victim stuck her head out between the advertisement as told in “her dream”.

5. Some have tried to crop Ko Wing-man’s statements to mislead the public. We will not be misled. He knows about the same as most of the public: nothing.
6. Victim condemned police brutality but never confirmed what caused her injury
7. The victim’s medical record is perhaps the only way to finding the truth

We do not wish to jump to any conclusions on what caused the victim’s injury. The truth can only be known from revealing the victim’s medical record regarding this incident.

The son of the victim approached the Complaints Against Police Office (CAPO) — an internal department of the force — in late June.
SUMMARY OF DISPUTED FACTS:
1. As to why the investigation took months:
Police spokespeople defended the CAPO on Wednesday, saying that they tried calling Chung (the victim’s son) four times – in early July, mid-July and early August.

“Since we were not able to reach [the complainant] to take a statement, it was impractical for us to carry on with the investigation earlier,” Chief Superintendent John Tse explained.

However, Chung refuted the official version of events: “In the first two weeks, they only sent one email to tell me they opened a file. I picked up every call, even spam calls, but [police] never contacted me by phone.”

2. As to why police did not check CCTV:
Police claimed they did not know about the CCTV installed at the ward, which was why they did not think to ask for it at the hospital.

“There was no intentional delay in the investigation progress,” Tse said, but admitted that the officer made an incorrect judgment call.

However, Chung once again disputed the account, saying that he explicitly told CAPO investigators to check the CCTV footage when he first made the complaint in late June.
ANALYSIS:
What the three officers did were categorically wrong.

On CAPO’s handling of the case:
1. It is difficult to determine the truth in a “he-said-she-said” scenario. Evidence involving call logs and other communication history is needed.

2. The investigators’ handling of the case definitely involved an incorrect judgment call but is consistent with the understanding by police officers that there are no CCTV cameras in hospital wards. This understanding is in line with common expectations of patient privacy. The logic is that if the three officers had the impression that there were CCTV cameras in such wards, they would not have committed such disgusting acts.
SUMMARY:
The three officers are legally/morally guilty. We look forward to the victim getting closure and justice. CAPO’s handling of the investigation definitely involved an incorrect judgment call, but more evidence would be needed to prove malice or intention to delay the investigation progress.

We are a group of five Hong Kongers aged 22-25. We have been classmates since young. What we share in common is objectivity and truth. What separates us is our political opinions.

One of us has been to almost every weekend protest, two of us have been to at least all of the peaceful rallies, two of us have been to none.

We believe all five of us have been trapped in our echo chambers. That is why we aim to analyse any evidence as a group to get to the bottom of rumours that seek to smear any side in this age of biased and unverified information. We hope that with our friendship and empathy we would be able to deliberate and come to objective and fair conclusions, by all five of us in agreement.
