The Demanding Annulment Process
Testimony #1

I have written in the past that it was my husband who filed for an annulment, that is after I filed a VAWC case against him. With my understanding that it may compromise my VAWC case, I hired a lawyer and countered his allegations of me being mentally incapacitated. The normal thing to do I've heard is this - if you are the defendant of an annulment case, you may just stay silent, don't hire a lawyer, don't pay.

As a defendant, I paid a hefty sum in cash for my lawyer's acceptance fee and significant amount for the subsequent appearances. To cut the long story short, today marks the day of the case dismissal. Dismissal.

Mine is an unusual case. I am the defendant. The ex on the other hand, did only the filing and made his lawyer appear twice, no witnesses. There had been multiple hearing schedules but the two did not bother showing up, always making up excuses - kasi seaman, palaging wala, cannot attend physically, eh di ba kaya nga may lawyer to represent him, pero wala talaga sila.

And so today, my lawyer asked for continuance for us to present our own witnesses - tuloy ang kaso kahit wala sila. To my shock and horror, the judge decided for a dismissal due to non-interest of the other party to pursue the case.

While I was advised that this is favorable to me, mas ma expedite or mapabilis daw if I file a new annulment case, well, I am now looking at the wasted money spent without achieving the goal of annulment. It's going to be a new case my lawyer told me, the fees will have to be discussed later - this is more traumatic actually than being separated from my ex.

Sharing this again when filing a VAWC case. In my personal experience, I think I could have avoided unnecessary fees, but yes money went to the drain. :(
