On Thursday 1st February, 2024 at around 11pm, a truck carrying Liquified Petroleum Gas (LPG) parked at an LPG gas refilling point situated in the Mradi area of Embakasi, Nairobi exploded resulting in the loss of lives and several injuries. The incident has caused public uproar among citizens demanding to know how an LPG refilling station was operational in a densely populated residential area and who is responsible for the incident. Whilst the Energy Petroleum Regulatory Authority (EPRA) has denied approving any applications for permits to operate the LPG refill station, there is still ambiguity as to the regulation of the sector and the remedies available to the victims of the incident. In this article, Esther Omulele, Billy Otieno and Brenda Gichangi explore the legal and regulatory framework surrounding LPG business, the penalties for operating without permits and the remedies available to the victims of the incident.

Just how much do you know about ChatGPT? Undoubtedly, this Artificial Intelligence chatbot has revolutionized the world of research since November 2022. Over a year since its launch, it is still the talk amidst tech giants who are scrambling to catch up. Powered by encyclopedic data, ChatGPT boasts of knowing everything. It certainly knows everything on the internet. Equipped with model conversational skills, ChatGPT will answer almost anything you ask. Don’t believe us? Try. But even with such prowess, ChatGPT has fundamental flaws. While it can and will in fact respond instantaneously to questions, the veracity of its responses may not, sadly be accurate. ChatGPT lacks the autonomous capacity to know how much on the internet is actually true. In a data-driven world, where information fuels innovation and propels economies, the need to safeguard such a valuable asset becomes paramount. Kenya's proactive steps to address data protection and privacy concerns are evident in the enactment of the Data Protection Act, 2019 (the DPA). The DPA is designed to regulate processing of personal data, with the Office of the Data Protection Commissioner (ODPC) as the vigilant guardian of data privacy in Kenya. Recent penalty notices issued by the ODPC against data controllers and processors, serve as a stark reminder of the consequences that arise from nonconsensual uses of personal data. In the wake of such penalties, the imperative role of consent in data privacy and protection becomes glaringly evident. In this article, Esther Omulele and Margret Wangari explore the nuances of navigating data privacy in Kenya, shedding light on the concept of valid consent prior to data processing and use.

Since the promulgation of the Constitution in 2010, the phrase legitimate expectation has become a byword in most constitutional petitions and judicial review applications. Courts have wrestled with the term with mixed results. In this article, our Senior Partner Daniel Musyoka argues that the Supreme Court has now settled the meaning of the phrase. A wish or desire, however earnest, cannot be a basis for a claim of legitimate expectation. The principle protects only those expectations which have arisen through the conduct of the administrative body concerned, and not those which have arisen as a result of one’s subjective hopes. A pious hope, even giving rise to a moral obligation, cannot amount to a legitimate expectation.

Last Week, we had an insightful workshop with KCB Bank Group on Public Private Partnerships. The workshop was headlined by our Managing Partner, Esther Omulele and Deputy Managing Partner, Isaiah Mungai Kamau. Maxwell Maelo from our Commercial Department made an elaborate presentation on PPPs. The discussions delved into PPP Projects and the role of KCB Bank in such projects. The session highlighted various opportunities in PPPs, particularly Road Infrastructure PPPs, with a focus on the successful projects like the Nairobi Expressway and Nyali bridge which have shaped Kenya’s landscape. The workshop concluded with a vibrant cocktail session, fostering a stronger bond between MMC ASAFO and KCB Bank.
