VA Business Owners - New COVID-19 Regulations Coming Out This Week!

The new VA Workplace Safety Standards regulations will require private businesses to follow certain COVID-19-related practices and procedures. The new regs will become effective immediately upon their publication in a major Richmond newspaper.

DOLI, the VA Department of Labor & Industry, will be providing PowerPoint slides on training, templates for creating an Infectious Disease Preparedness and Response Plan and other guidance documents.

Business Owners during Reopening Phases
– Is Protecting Your Business Top of Mind for You? (Part 3)

Our previous post (Part 2) was about what Business Owners should include in an Employee Consent Form.

Next question pertains to Health Screening of your Staff – what do you screen for, how often do you screen, and what kind of records should you keep of each screen?

The states (and even local) governments have different laws on whether temperature checks or other health screening procedures or questions are required. Here are some general recommendations, but please remember to check your state and local laws for specific regulations.

1. As the employer, you should conduct a health screening of all your employees and independent contractors (“Staff”), whether required by law or not, for the purpose of lowering the risks of someone getting sick.

2. If your Staff goes out for lunch or to run an errand, should you do a health screening of them when they return? YES – every time they leave your premises! (They’ve been out and about and possibly exposed!)

3. Keep logs of who conducted the health screening, who was screened and the dates and times of all such screenings.

4. It is probably best not to keep records of the results of all such health screenings, but it depends on whether you are permitted by your state and local laws, and whether you want to comply with applicable privacy laws.

5. The exception (to not keeping records of the health screening results) is if one of your Staff members tested positive for COVID-19, but in those cases, you need to follow privacy and HIPAA-related regulations.

To Do List - Create a paper form log to use for Health Screenings, or use an online app or system, but make sure your questionnaire is complete. (Many online health screening questionnaires are not!)

In Part 1, the main point was Employee Consent Forms are important to have.

Next question – what should be included in these forms or what should your staff be agreeing to in these forms?

1. Have their temperature checked.
2. Each time they report to work, answer questions about whether they’re experiencing any other COVID-19 symptoms, such as chills, headaches, loss of smell, etc. (Use the whole list!)
3. Follow all your COVID-19 related (and any other safety) rules and procedures.
4. Contact you if they experience any COVID-19 symptoms.
5. Follow all your rules about what they should do after the onset of any COVID-19 symptoms.

Add to your TO DO LIST -- Check that your Employee Consent Form includes these details.

Louisiana joins 4 other states (NC, OK, UT, WY) with law giving businesses immunity from COVID-19 lawsuits!

Does this mean that business owners in these 5 states can now just focus on re-vamping their business? Unfortunately, NO. These new state laws have contingencies. (We'll cover those details in upcoming posts).

BOTTOM LINE FOR BUSINESS OWNERS: continue to follow your state's reopening requirements and maintain a "legal record" of all that you do.
