For about 3 weeks now,we have being discussing the Topic "Marriage and it's Validity" on Air. And this topic has given rise to a subtopic which we commenced Last week - "COHABITATION"
As an overview of previous discussions, Marriage simply put is a Union/Contract between a consenting Male and Female adult to live together as Husband and Wife.
From the Foregoing,we can easily identify the Factors that must be present for a Marriage to be Accepted in Nigeria. These factors include
*🟣Contract
*🟣Consent
*🟣Age
*🟣Gender
🔺Like every other simple contract, Marriage begats responsibilities,Rights and Liabilities.
There must be consent, this consent must be explicit and not falsely obtained
The parties involved must be Adults (18 and above)
They must be a male and Female (this implies that same s*x Marriage is not recognized and acceptable under the Laws of Nigeria)
F🔺urthermore, for a Marriage to be valid,it must conform with at least of of the kinds of Marriages in Nigeria. Which includes
*Statutory Marriage (Court or Licensed place of Worship)
*Customary Marriage (According to the Laws and norms of a particular place)
There are also different Types of Marriages in Nigeria, which includes
*Monogamy (One man,one wife)
*Polygamy ( one man, many wives-usually under customary law)
**For more adumbration on the above, pls watch me life on the 3rd July Episode of Everything Legal on Facebook on The Reach 104.9.
The above explanation of Marriage, now gives rise to what we commonly see today "COHABITATION"
Cohabitation simply put is Living together of a Man and Woman without being Legally Married or without conforming to either or all kinds of Legal Marriage in Nigeria.
Cohabitation is seen Everywhere in our clime and tends to pose a huge risk in the lives of parties involved.
Many people do not know that Offsprings (Children) from cohabitation are regarded under the law as Illegitimate children.
Cohabitation does not give rise to any responsibility or obligation in the union.
Parties are free to do what they like and even have relationship with other people because the Law doesn't frown at it, even morality.
Those who are into Cohabitation has risked being accused of kidnapping or even killing their partners in cases of eventualities.
The worst is that if a man is living with a woman who he isn't legally married to,and a woman dies for instance,in Igbo land, the man is even forced to pay the woman's Brideprice even in death , before even thinking of burying her. So why risk it?
Sometimes, the girl's parents even accuse the Man of kidnap and the parents even deny total knowledge of the Girl's way about.
Some examples of Cohabitation includes
-🌺Young men and girls living in the same room in Hostels
-🌺 People who use the term "They have done small something on my head😊😊"
-🌺Adults who now live together as Man and wife and have kids"
