The recent termination of over 250 illegal appointees in the Education Department without getting arrested by the SIC ,signifies a positive move by the government to uphold transparency and fairness in its recruitment processes. This action not only reflects a commitment to ethical governance but also instills confidence among the public regarding the integrity of the civil service.

However, a glaring inconsistency emerges when comparing this decisive action in the Education Department with the ongoing case involving the Arunachal Pradesh Public Service Commission (APPSC). Despite the revelation by Mr. Taket Jerang, the prime accused, implicating several officers who allegedly gained advantages in securing their positions, there is a conspicuous lack of similar punitive measures.

The pressing question is why these implicated officers in the APPSC case are not facing termination or, at the very least, a comprehensive Departmental Inquiry. The absence of such actions raises concerns about the government's commitment to applying the same standards uniformly across different departments.

To ensure a consistent and just approach, it is imperative for the government to maintain the same principle in dealing with illegal appointees, whether in the Education Department or the APPSC. This not only reinforces the credibility of the government's anti-corruption efforts but also streamlines the process of distinguishing between tainted and untainted officers.

In essence, a uniform application of principles in dealing with illegal appointments would not only align with the government's commitment to integrity but also facilitate a more efficient and transparent system of governance.

BEHIND THE SCENE OF EDUCATION DEPARTMENT AND THE GHOST TEACHERS

In accordance with the report, the Education Department conducted a DPC(DEPARTMENTAL PROMOTION COMMITTEE ) to consider the regularization and promotion of SSA teachers. Many teachers were promoted accordingly.

In addition to the promoted SSA teachers after the DPC, they illegally appointed 28 fake PRT teachers in Longding district with the help of brokers, accountants, and DDSE. These 28 appointed teachers were not named during the DPC. And During the course of the investigation, another 10 fake appointed teachers were found, bringing the total to 38 teachers.

After intense interrogation by the SIC, they revealed that the appointments were made back in 2020 during the pandemic. Their service records were maintained, and monthly salaries were taken by the DDSE, brokers, accountants, and whoever else was involved. Payments were never made to the appointed teachers for two years, as they joined only in 2022, but were shared among the accused persons.

Note: The investigation is ongoing, and brokers along with a few officers involved in this case are trying hard to clean their hands. So until the SIC doesn't arrest them, their identity will not be revealed on social media.

The Govt of Arunachal Pradesh Files a PETITION for SPECIAL LEAVE TO APPEAL(criminal) arising out of impugned order dated 14/09/2023 in AB No 51/2023 passed by Gauhati High court at Itanagar, granting Pre-Arrest Bail to accuse Tapi Gao.

The petitioner was Govt Of Arunachal Pradesh and respondent was Tapi Gao.
However, Supreme Court passed the order in favour of accuse and dismissed the SLP saying that no ground for interference is made out to exercise their jurisdiction under Article 136 of the Indian Constitution.

Analysis: The Govt needs to give free hand to the SIC to investigate more and collect the evidence against the accused. Due to the lack of evidence, court is bound to give judgement in favour of Accuse.
Secondly, why it was deemed necessary to go to Supreme court just for Anticipatory Bail. Govt should focus more on investigation during the initial stage.

Two ineligible candidates were allegedly allowed to appear in the recently held examination conducted by Arunachal Pradesh Public Service Commission (APPSC) for the post of Agriculture Development Officer (ADO), claimed Arunachal Agriculture Students’ Welfare Association (AASWA).
Two candidates with Horticulture graduation were allegedly allowed to sit in the examination for recruitment to the post of ADO by APPSC whereas the requisite qualification for the said post is BSc (Agriculture), AASWA said in a release and sought apology from the Commission for the blunder.

SIC went to investigate the APPSC case after the Revelation of paper leakage by GYAMAR PADANG but found many relevant documents pertaining to ILLEGAL APPOINTMENT in EDUCATION DEPARTMENT. And today it is in public domain. More than 250 PRT, MTS, LDC etc has been terminated in a single day.

The outcome of any issue related to corruption is always dependent upon the investigation agency. No matter how we go around and shout in the street, ultimately the investigation will gives us justice. So we as a public should support them and provide any inputs at any time to speed up the investigation process.

Arunachal is changing and moving forward and we as a part of the society acknowledge the efforts done by SIC in investigating a serious matter.

Update from Yupia High Court

In the line with Honourable Supreme Court order granting bail to prime accused Taket Jerang, Yupia High Court has granted bail to Talung Jomang, father of accused Binam Jomang (related to AE Civil 2022 case) & Kabit Jomang (AE Civil 2019 Rank 40).

He was arrested on 30/9/22 for CBI Case No. RC0172022A0009 & on 10/11/22 for CBI Case No. RC0172023A001.

With this order, now all the accuse of APPSC are out on bail.

UPDATES FROM YUPIA HIGH COURT

The Yupia High Court has granted interim Pre-arrest bail to Shri Rudra Bahadar Thapa in connection with SIC(Vig.) PSC/ No. 04/2023, registered u/ss. 120(B)/420/468/471/409 of the Indian Penal Code, read with Section 13(2) of the Prevention of Corruption Act, 1988.

The instant bail application was filed by the accused applicant, mainly on two grounds: one ground touches the merit of the case, and the other ground is on medical ground. The allegation pertains to corrupt practices at the time of appointment of Teachers in the Department of Education, Anjaw District, Arunachal Pradesh. The First Information Report(FIR) was lodged by Inspector Shri Techi Nega, Investigating Officer of the SIC(Vigilance) Police Station.

After perusal of the CD which was produced by Mr. Ojing Pada, learned Special P.P.(SIC); the Honourable Court found that the SIC should be given some more opportunity to further investigate the matter and regarding the medical ground of the accused applicant; the Court is of the considered view that he has genuine medical problems.

Therefore, as an interim measure; the Court directed that in the event of arrest of the accused applicant Shri Rudra Bahadur Thapa, he shall be released on an interim pre-arrest bail on his furnishing a bond of Rs. 25,000/- with a surety of like amount to the satisfaction of the arresting authority subject to the condition that he shall appear before the I.O. of the case, as and when required.

The matter is in investigation and will be heard again on 08/12/2023.

Year 2003:
My first world cup experience, watched all the matches of team India, loosing only to Australia in group stages and then come back strongly to marched into the final.We were too young but too excited to see our team lift the trophy.

Alas on 23/03/2003, stage was set for the grand finale and comes the whirlwind start by Gilchrist and Hayden followed by the Man of the final and captain himself, Ponting hit every bowler out of the park. Every boundary he hit was as like nail driven into my body. Soon a daunting target of 358 was set for India to lift.
Comes sachin and sehwag. The master blaster couldn’t survive the pinpoint accuracy of Mcgrath which marked the downfall of team i prayed to win the world cup. The lethal pace of Bret lee and part time bowler late Andrew Symond tear apart entire team and we lost by 125 runs in the final.

The pain, the memories and the ghost of final is still afresh. 20 years later Rohit and Co has been a delight to watch every single ball and every single run they scores. The team has so much depth that only an unforeseen or a silly mistake can let the team fall again in front of 130000 crowd at Ahmedabad. Or else this team has no any flaws or drawbacks. This team is assembled like an AVENGERS and hence they can only undo the pain and loss we endured in our past by just winning this final match just like the GAUNTLET did in the Endgame.

Truely its amazing to see Indian Cricket Team to win 10/10 without missing any match. The team gave us so much of joy and happiness in a month that we are bound to worship them. No matter what the outcome may be, we have seen a team of unmatched excellence individually and this team will surely come out as winner at the end…

UNTOLD AND MISFORTUNE STORY OF SI(CIVIL/IRBN) 2021 EXAM CONDUCTED BY APPSC

In regards to 2021 SI(Civil/IRBN) exam, COURT has taken serious action against APPSC and said that ERRONEOUS MODEL ANSWER KEY FOR EVALUATION OF ANSWER SCRIPTS OF CANDIDATES APPEARING IN COMPETITIVE EXAM IS BOUND TO LED TO ERRONEUS RESULT.

COURT has found that the answer key of few questions were wrongly printed due to which two aspirant got deprived by 1 or 2 marks even after they correctly answered the question. Hence they filed a case for re-verification or re-evaluation of answer key by an expert so that they can be appointed to the post of Sub-Inspector (CIVIL/IRBN). The two candidate scored 197.33 and 198.66 respectively. And as per their claim, they will get 2 marks and 1 marks respectively if APPSC goes for re-verification. The last rank scored 199.16

The advocate for respondent Mr M. Pertin have relied upon Pramod Kumar Shrivastava (supra) to contend that in absence of any provision for re- evaluation of the answer books in the relevant Rules, no candidate in an examination has got any right whatsoever to claim or ask for re-evaluation of his marks as Arunachal Pradesh Public Service Commission Conduct of Examination Guidelines, 2017 does not provide for re-evaluation of the Answer Script.

DIRECTIONS by Honourable Court:-
Under the aforesaid facts and circumstances, this court is inclined to issue following direction:-
1. APPSC shall evaluate the correctness of Answer Key in respect of Question No. 18 & 96 of the Elementary Mathematics Question Paper and Question No.57 of GENERAL KNOWLEDGE PAPER through an independent, experienced and expert examiner.
2. And if the same is found to be not correct then to prepare correct Answer Key in respect of the said Question No.18 & 96 and 57.
3. And thereafter, to re-evaluate the Answer Script of the petitioner and to take follow up action.
3. This exercised has to be carried out within a period of 1 [one] month from the date of receipt of this order.

DEEP ANALYSIS:

a) FAIRNES AND JUSTICE :
The court's decision to re-evaluate the answer key for specific questions is a commendable move towards ensuring fairness and justice in the examination process. It acknowledges that mistakes in the answer key can have a significant impact on candidates' results, and rectifying these errors is essential to uphold the merit-based selection process.

b) LEGAL CHALLENGE :
The case brought by the two candidates who scored 197.33 and 198.66 demonstrates that individuals who believe they have been unfairly treated by errors in the examination process have the right to challenge the results in court. This sets a precedent for accountability and fairness in competitive exams.

c) LACK OF CLEAR RULES:
The advocate for the respondent, Mr. M. Pertin, cited the absence of provisions for re-evaluation in the relevant rules and guidelines of APPSC. This highlights a crucial issue – the lack of a structured mechanism for addressing errors in the evaluation process. It's essential for examining bodies to have clear rules and procedures for handling such situations.

d) TRANSPARENCY AND PUBLIC TRUST:
A rigid approach by APPSC might harm the trust of the public and aspirants in the examination process. Public trust is essential for the credibility of any examining authority, and transparency in dealing with errors is a crucial factor in maintaining this trust.

e) Standard Operating Procedures (SOP):
A new SOP must be drafted to address the risk of errors or leakage. A well-defined SOP can guide the examination process, provide a framework for addressing mistakes, and ensure that the examination remains fair and free from discrepancies. Public opinion in this matter can help in shaping a more robust system.

In summary, the case and the court's directions highlight the significance of maintaining fairness, transparency, and justice in competitive exams. A comprehensive and transparent SOP can go a long way in preventing errors and restoring public trust in the examining authority.

The final ORDER of Writ petition filed by Colonel Koj Tari and Rosy Taba in case no IA(c) 182/2023 in WP(c) 223/2023, and IA(c) 183/2023 in WP(C) 213/2023 respectively will be on Monday,6/11/2023 at Yupia High Court.

We are hopeful that the Honourable Court will come to conclusion and disposes off the case at earliest.

The ARUNACHAL TIMES recently published an article titled "GOVT SETS UP INQUIRY COMMISSION TO INVESTIGATE TUMI GANGKAK'S DEATH" on 18/10/2023.
The report states that the state government has established a one-man Inquiry commission chaired by Justice HK Sharma, a former judge of the Gauhati High Court, to investigate the death of Late Tumi Gangkak. The commission is expected to submit the report within 60 days from the date of its appointment.

However, a few observations can be made from the article:

1. A one-man Inquiry was already set up on 17/08/2023 by the state government. Therefore, it raises questions as to why ARUNACHAL TIMES, the most reliable and famous news channel in the state, is publishing the article now when it could have been published earlier.

2. The most recent news was a Public Notice issued by the one-man commission itself, inviting written statements of facts from the state government, District Administration, officials, aggrieved persons, or anyone acquainted with the subject matter of the inquiry within 15 days from the date of publication. However, ARUNACHAL TIMES failed to explicitly mention this report in their article.

3. ARUNACHAL TIMES could have been a better platform to enlighten the public about the case, appealing to them to come forward and submit any information they have to the commission.

4. The reason or requirement of a one-man commission for monitoring the case arose mainly because of the lackluster, biased, snail-paced, and malafide investigation of the State police. These reasons, which carry weight in the eyes of the public, should have been highlighted by ARUNACHAL TIMES.

5. The Arunachal Times even failed to report anything about the outcome of the one-man inquiry report, which was supposed to be submitted after a period of 60 days on 17/10/2023.

6. In a high-profile case like this, the role of the media fraternity and their voices cannot be underestimated as they become the voice of the masses. The fourth pillar of democracy needs to be unequivocal, keeping in mind the sentiments of the masses, and should put pressure on the government to ensure impartiality in the outcome of the investigation.

WAY FORWARD:
As responsible citizens or any members of the media fraternity, it is our prime duty to expose the lies of the state government and to advocate for public sentiments. Freedom of speech cannot always be well interpreted by aggrieved families, but media houses can use this freedom to represent the voices of aggrieved families. Hence, we appreciate ARUNACHAL TIMES and other media house of the state for their hard work in enlightening the entire Arunachal through their articles. At the same time, we expect more from them in terms of standing with the aggrieved families and providing more details about the findings of the report.

Lastly , I would like to appeal general public, aspirants , Govt Officials and like minded people of the state to give their valuable inputs to the commission and help the family to get justice soon.

Earlier on 17/08/2023, the Governor of Arunachal Pradesh has constituted a ONE MAN INQUIRY COMMISSION to be headed by Justice H. K Sharma, retired judge to cause an inquiry into the death of Tumi Gangkak under section 3 of Commission of Inquiry Act, 1952. The commission shall submit the report within a period of 60 days which will end on 17/10/2023.
