Maaari bang mag-endorso ng kandidato ang religious groups?

Sa tuwing ang usapan ay ang pag-endorso ng mga relihiyosong grupo at mga simbahan sa mga politiko, lumalabas ang issue ng separation of church and state dahil isa ito sa prinsipyong nakapaloob sa Article II ng 1987 Constitution. Ngunit kung tutuusin, madalas ay mali ang pagkaintindi sa konseptong ito. Ang separation of church and state ay isang constitutional right na pumipigil sa pamahalaan na makialam o pumigil sa mga aktibidad ng simbahan. During the Jacobean Era, specifically in the reign of King James I, Sir Edward Coke opposed the claim of the King to Divine Rights. For Coke, the law limited the royal authority. Which Coke, "the common law took flesh." Neither the King nor the Parliament was superior to the law. "In many cases the law will control acts of Parliament and sometimes adjudge them to be utterly void." He resurrected Magna Carta and retranslated it. "No Man," he wrote, "shall be imprisoned except by due process of the common law, the native, English law." The moving spirit behind the Petition of Right of 1628, he pleaded against weakening the "foundation of laws," or the building would fall.

In The Laws, Cicero explored his concept of natural law. "Law is the highest reason," he wrote, "implanted in Nature, which commands what ought to be done and forbids the opposite." Thus, natural law is the guide for right and wrong in human affairs.

Since reason "is certainly common to us all," Cicero asserted, the law in nature is "eternal and unchangeable, binding at all times upon all peoples." Cicero warned that it was "never morally right" for humans to make laws that violate natural law.

Without laws, Cicero reasoned, there can be no state or government. More important, he continued, there must be equality under the law with no special exceptions. This is essential, he said, for justice, which in turn is necessary for a successfully functioning government.

In The Republic, Cicero argued that laws are not enough for a just state. There also must be liberty. "But if liberty is not equally enjoyed by all the citizens," he declared, "it is not liberty at all." Therefore, liberty cannot exist unless "the people have the supreme power" in government.

Cicero looked into the ideal form of government for upholding natural law, establishing justice, and ensuring liberty. He started by examining three "good states" and their perverted forms, described earlier by the Greek historian Polybius.

Ano ang Domestic Administrative Adoption and Alternative Child Care Act?

Ang Republic Act No. 11642 o ang Domestic Administrative Adoption and Alternative Child Care Act ay isang bagong batas na nilagdaan ngayong taon. Ito ay isang batas na naglalayong padaliin ang proseso ng domestic adoption o pag-aampon sa pamamagitan ng paggawa ng proseso na administratibo at hindi na dadaan sa mga korte. Dahil ang proseso ng pag-aampon ay ipinapasa na sa National Authority for Child Care (NACC), isang attached agency sa Department of Social Welfare and Development (DSWD), may magiging madali na ito at hindi magiging magastos kung ang isang bata ay idineklarang child legally available for adoption (CLAA). Ano ang quantum of evidence?

Ang quantum of evidence, o minsan ay tinatawag ding quantum of proof, ay ang dami, bigat, kalidad, o lakas ng ebidensyang kailangan para mapatunayan ang iba’t ibang isyu sa isang kaso. Ito ay isang pamantayan na ginagamit upang mahusgahan kung sino ang mga mananalo sa kaso. Iba iba ang quantum of evidence na kailangan sa iba’t ibang klase ng kaso. Ano ang exceptions sa krimen na qualified trespass to dwelling?

Ayon sa Article 280 ng Revised Penal Code, ang isang pribadong tao na pumasok sa tahanan ng iba nang walang pahintulot ay pinaparusahan ng batas. Ibang usapin ito kung mga empleyado ng pamahalaan na naatasang magpatupad ng batas ang pumasok sa tirahan dahil ito ay saklaw ng ibang probisyon ng RPC. May mga pagkakataon kung saan bagama’t pumasok ang isang pribadong tao sa tahanan ng iba nang walang pahintulot, hindi ito maituturing na trespass to dwelling. Halimbawa na lamang ay kung ang pagpasok ng isang tao sa nasabing tahanan ay upang mapigilan ang seryosong peligro sa buhay niya o sa buhay ng ibang tao. Isa ring exception sa batas ay kung ang pakay ay magbigay ng justice o humanitarian service.

Just like every good piece of legislation, the party-list system act had a good vision--a system that recognizes the voice of the poor and marginalized. But self-regarding politicians ruined it because of their greed for power. The law needs to be revisited soon.

Now more than ever, we need a leader who will restore our fundamental institutions--education, justice system, economy, media, environment family--not destroy them. When these institutions are strong, we have a fighting chance to achieve true development.

May parusa ba ang pagsasabi ng homophobic at transphobic slurs?

Ang mga transphobic at homophobic slurs or remarks ay mga salitang nanlalait o nagpapababa ng dignidad ng mga miyembro ng LGBTQIA+ community. Ang mga remarks na ito ay kadalasang ginagamit upang i-harass sila. Ang ganitong uri ng harassment ay pinarurusahan sa Republic Act No. 11313 o ang Safe Spaces Act of 2019.
