CANCELLATION OF CERTIFICATES NOT DESIGNATED AS ESSENTIAL SERVICES

During the course of its review of the Essential Service list of applications, the Companies and Intellectual Property Commission (CIPC) has established that certain companies not designated as Essential Services have either fraudulently or negligently applied on the Bizportal website (www.bizportal.gov.za).

As was made clear when the automated certificate was issued by the CIPC, that the provision thereof was based on information provided by the registered Company itself, and that possession thereof does not in itself constitute the right to continue operating during the lockdown period.

The operation of any essential service is subject to full compliance with the applicable lockdown regulations and that the company falls within the scope of essential services as defined in the regulations.

In a number of cases, companies have applied and received Essential Service certificates without compliance with the regulated conditions.

In terms of the applicable regulations during the lockdown, all businesses shall cease operations except for any business involved in the manufacturing, supply and /or provision of an essential service or goods.

It is a criminal offence for any business to continue operating during the lockdown period if it is not providing an essential service, as defined in the applicable regulations and direction, unless such business can be operated using work-from-home arrangements. It is also a criminal offence for any business which misrepresents the nature of its operations in order to obtain a CIPC certificate.

The CIPC, upon review, has established that pubs, taverns, restaurants, fast food places, pizza parlours and the like have registered to continue operating during the lockdown, in violation of the applicable regulations as per the Essential Service list. Artist Advisory seminar:
These are some of the questions that we have received and will be discussing on the online seminar with Chiba Attorneys who are offering their professional services at the seminar free to the arts sector.
Join in on the Market Theatre Foundation’s Watch Party on Wednesday 8 April at 14:00.

The questions that we are going to discuss are:
1. FORCE MAJEUR:
a. The National Lockdown has caused a forced closing of shows. Everyone is referring to it as a Force Majeur. What exactly is meant by Force Majeur? Why is it necessary to have a Force Majeur clause in contracts? What happens to contracts that don’t have a Force Majeur clause?

b. As a result of the Force Majeur cancellation can artists claim any compensation?

c. If an artist has received 60% funding for a development of a production for a festival that was supposed to take place in May but the Festival is now cancelled, is the artist entitled to keep that funding for expenses already incurred, claim the balance or pay back the funding?

2. UNEMPLOYMENT INSURANCE FUND:
a. What do I as an artist need to know about UIF?

b. Who pays the UIF? The employer or the employee?

c. How will I know if there has been UIF taken off my salary?

d. How can I can claim UIF?


3. POSTPONEMENT OF EVENTS:
a. If I was supposed to perform in a show during April but the show is now postponed but not cancelled and I budgeted for the April money is there any way that I can claim some money or ask my employer for an advance?

B. If the show was supposed to be in May but the theatre has now postponed it to September but I am not available in September what rights do I have if the theatre replaces me with another actor?

4. AD HOC WOKERS:
A. I am a sound technician but I work ad hoc for a Theatre. If there is a show I get paid. If there are no shows I don’t get paid. Is there any claim for payment that I can make now that everything is cancelled and I have a loss of inc

PLEASE SHARE: *HOW TO COLLECT A SOCIAL GRANT DURING LOCKDOWN*

You *can still collect your grant* during the lockdown. To try and stop the spread of the coronavirus, SASSA is helping people *avoid crowds*.

*Payment will be as follows:*

🧓🏽 *30 and 31 March: Old Age and Disability grants will be paid.* This is ahead of the rest of the grants so that the elderly and those with a disability don’t have to stand in long queues. Less people will then have to queue at grant payment centres later (SAPO, Postbank, Merchants, commercial banks, pay points, etc.).

👪 *1 April onwards: Child Support, Foster Care, War Veterans and other grants will be paid.*

⏰ *If you are able to wait a bit longer before you collect your grant, please do, so you can protect yourself and others from the coronavirus.* (Grants are in your account for at least three months from the date of payment.)

🆔 + 💳 *Carry your ID and your SASSA card or bank card* (for those who do not use the SASSA card).

🚍 From Monday, 30 March to Friday, 3 April, *buses and taxis can run* from 05h00-20h00 (more information to follow).
