Thank you Jeffrey Kraft for an informative presentation yesterday on Mitigating the Risk of Liability for Ensuring Jobsite Safety

09/01/2023

Upcoming CMAA Event!

PRESENTATION DECRIPTION:

Am I My Brother’s Keeper?: Recognizing and Mitigating the Risk of Liability for Ensuring Jobsite Safety

Extracontractual liability owed to third parties represents a significant potential unintended and unpredictable risk for construction managers. One on the most common of such extracontractual liabilities is the risk of assuming a legal duty to ensure jobsite safety and thus potential liability for jobsite injuries under a claim of negligence. Through examination of real-world examples from past Indiana cases, this presentation will discuss how a construction manager may unintentionally take on this duty either by contract or by action, as well as methods for limiting such risk.

MEET THE PRESENTER:

Jeffrey M. Kraft, Drewry Simmons Vornehm, LLP

Jeff is an attorney practicing primarily in construction law and general civil litigation. He has experience representing individuals and businesses across the construction industry (owners, developers, general contractors, subcontractors, architects, engineers, surveyors, etc.) in a wide range of construction-related claims, including: design/construction defect claims; performance/payment disputes; lien actions; breach of contract claims; professional liability claims; personal injury claims (job-site injuries, slip-and-falls, car accidents); defamation claims; breach of non-compete/confidentiality agreement claims; and environmental compliance/site cleanup claims. When not representing clients, Jeff spends most of his time at home in Westfield, Indiana with his wife, two energetic young kids, and one ungrateful old cat.

09/09/2022

Upcoming Event!!!

September 22, 2022
11:00 AM - 12:30 PM

The I-65/I-70 North Split interchange was built nearly 50 years ago, is operating at full capacity and is at the end of its useful life. This is the first project to completely reconstruct the interchange, bridges and pavement along the North Split since it was built in 1968.

The interchange will have a smaller footprint than the existing interchange when construction is complete, and no new right of way will be required.

The redesigned interchange will improve safety by eliminating the weaving sections (locations where traffic is forced to cross paths) on the west leg of the interchange near the Pennsylvania and Delaware Street ramps. Eliminating the weaves will also remove the most severe bottlenecks in the interchange, allowing for improved traffic flow without adding new through lanes.

MEET THE PRESENTERS:

J. Michael Stair, P.E.

Mike is currently the project controls section manager and at HNTB. He has over 22 year of experience with construction and project management. Mike is a fourth generation Purdue graduate with a degree in civil engineering. He is currently working with INDOT as the construction manager for the North Split I65/I70 project.

Cliff Walker

A former toy specialist (sales associate) for Toys R Us, Cliff graduated from the University of Kentucky in 2007 with a bachelor’s degree in Civil Engineering. He began his career with the Indiana Department of Transportation (INDOT) in 2008 and accepted a position shortly thereafter as an INDOT Project Engineer in the Greenfield District. Cliff has overseen the construction of multiple contracts along the US31 corridor (US31 Kokomo bypass, US31 Carmel reconstruction, SR28 Tipton Interchange), as well as the SR37 reconstruction in Fishers and now the Indianapolis North Split Interchange.

About Second Helpings:

For more than 20 years, Second Helpings has operated a three-part approach to addressing hunger and poverty in Central Indiana. Each day, Second Helpings volunteers and staff rescue prepared and perishable food from wholesalers, retailers and restaurants – preventing unnecessary waste. That rescued food is used to create more than 4,500 nutritious meals each day that are distributed to more than 90 social service agencies that feed Hoosiers in need.

Using that same rescued food, Second Helpings Culinary Job Training program prepares adults with barriers to employment for careers in the food service industry. This helps eliminate hunger and poverty at its source. More than 900 adults have graduated from this program. Second Helpings alumni are working in Central Indiana as cooks, executive chefs, business owners and culinary instructors.
