There's kidnap strategy bad boys have adopted in kidnapping their victims in Abakaliki. They enter into popular hotels, sit down drinking and be monitoring people that come into the hotels or gardens. When any of them they suspect is rich drives out, they rush into their own vehicles and double-cross them outside the hotel, force them into their own vehicles and take them to hostage.

Three weeks ago, a young man from Ikwo whose surname is Achor returned from America. He lodged in a popular 5-star hotel at Mile 50, Abakaliki. While driving out, these boys accosted him and forced him into their own vehicle. They drove him to a popular forest at Ishieke where one of the campuses of the Ebonyi State University is located. They held him hostage there for a couple of days.

The ransome was ready for them to collect and release him. While the others went out to the designated point where the ransome was to be delivered, they left one of the kidnappers to look after the young man. He had overheard them saying that they (kidnappers) would waste his life after the payment of the ransome as they felt he recognised them. Luckily, he garnered morale and confronted the young boy left with him them. He overpowered him and let loose himself. He ran away from the captivity as he blew the hell out of his head such that he had no strength again to chase him.

That's how he escaped death. These criminals take inventory of people who return from abroad and go after them. They even told this one that they tracked him for two weeks until they finally got hold of him. You know there's no population in Abakaliki, reason they easily know who comes in and who goes out. Another woman a week ago was greeted with same treatment. She was kept in the same forest. The hotbed of this menace is the environ of this hotel. The owner was sometime ago also kidnapped in front of the hotel and almost killed as he was shot into a river. A girl carried it out. Everyone is aware of it. At the point of trying to pull his money from his account in the bank in Abakaliki, police caught them and I suspect they may have gone out of this world.

So, it's advised that you manage your movements and presence around these popular hotels and joint in town. These criminals are not far from being the disengaged Ebubeagu security network officials established by the immediate past administration of David Umahi. The police in Abakaliki almost are irresposive to these threats. They are aware of the menace. Once you arrive in a quality vehicle, they suspect you are rich; next is to plan about your kidnap. Many have been silently kidnapped since after the 2023 polls in Abakaliki. No publicity is given to it. This Ishieke forest is their regular den. One wonders why such a forest is still condoned within the state capital in the name of forestation.

IKE EKWEREMMADU'S LIES THAT GOT HIM SENTENCED AND MADE DAVID THE VICTIM.

David Ukpo Nwamini is the 21-year old Lagos street hawker who was to give his kidney to Ekweremaduโ€™s daughter IN London. When he was interviewed at the hospital in London, they asked him if he knew he was to donate his kidney to Sonia Ekweremadu. He first told them that he had no money to donate. They explained to him that it was his kidney that he was to donate. He asked them what was kidney. Initially, the doctors thought it was a question of language, since Davidโ€™s English was not good enough. However, they eventually understood that David did not know which human organ was called kidney. In other words, he did not know what organ he was to give Sonia. That led the doctors to conclude that the procedure was not well-explained to David and that is the number one requirement by law. According to the law, you must explain to the organ donor the procedure and all the health risks associated with the procedure. It is only then that the donor is taken to have informedly consented. When the doctors found that David did not understand what he was about to get involved in, they declared him a mismatch.

The term โ€œmismatchโ€ is a technical generic language to indicate that the proposed organ harvesting has not met all the requirements. Many in Nigeria have misunderstood the term โ€œmismatchโ€ in this case to meant that Davidโ€™s kidney was not suitable for Sonia. No! There was nothing wrong with Davidโ€™s Kidney. To donate an organ, the facts must match both the law and the science governing the procedure. While the kidney matched the scientific requirement, the facts did not match the legal requirement. So, it was declared a mismatch. To help you understand it better, the term โ€œmismatchโ€ means there is a discrepancy.

The doctors who interviewed David did not and could not have determined that a crime was committed. The doctors did not have sufficient information to reach such conclusion then. They felt uncomfortable with the discrepancies in the information they had about the donor and his decisions and whether he had made up his mind. For instance, the doctors did not get involved in how David was brought to them or whether he was paid. It was not their duty to deal with that. It was actually when Ekweremadu and Dr. Obinna attempted to return David to Nigeria that the problem started. David expected that he would be given a job in London as he was told before he left Nigeria. They did not give him job and they did not send him to school. Instead of all he was promised, he was asked to prepare to return to Nigeria and David ran away from the house where he was kept. As hunger wired him, he reported himself to the police. To win the immediate protection of the police, he lied about his age by telling them he was 15. It was when he was interviewed by the police that the information came out which established that a crime was committed. For instance, it was at the police station that they asked him if he was paid money and he said yes he was paid N270,000. When the police checked the WhatsApp chats between Ekweremadu and Dr. Obeta they realized that Ekweremadu actually paid 4.5 million for Obeta to pay to David. But Obeta only paid David N270,000 and pocketed the rest.

In fact, Ekweremadu tried to keep himself away from certain details of the deal. That was why Ekweremadu never discussed money with David. In fact, he did not deal directly with David. That was what made it possible for Obeta to cheat him. Ekweremadu believed that the 4.5 million went to David. But since he was not dealing with David directly, he never knew that Obeta pocketed most of the money. However, the law viewed Ekweremaduโ€™s decision not to deal directly with David as a typical behavior of a big man who knew that he is getting involved in a crime. He would usually try to create some distance between him and the crime, yet he will be funding the crime from afar. Otherwise, how come you never wanted to meet the boy that is giving his kidney to your daughter and whom you called cousin to your daughter (which actually makes him your nephew)? Rather than see the non-direct dealing as evidence of his innocence, it was seen as deliberate or willful ignorance aimed at evading legal responsibility.

One of the key factors that worked against Ekweremadu was that he lied. On three official documents he signed, he stated that David was Soniaโ€™s cousin. But in all the WhatsApp chats he had with the doctor and his own brother over the matter, he referred to David as โ€œthat guyโ€. Hence the question: โ€œYou knew he was not Soniaโ€™s cousin. While you signed that he was her cousin, when you wanted to say the truth, you referred to him as โ€œthat guyโ€, meaning you didnโ€™t know him or even remember his nameโ€. Ekweremadu admitted in court that he lied and apologized.

NOTE: I decided to provide these details because I have read somewhere it was being said that David misled Ekweremadu and took advantage of him. No, David is a real victim. He did not manipulate them. He was manipulated by Dr. Obinna Obeta, who was working with Ikeweremmadu

*Expulsion: Senator Chimaroke Nnamani Is Out Of February 25 General Elections.*

With the expulsion slammed on Senator Chimaroke Nnamani by the People's Democratic Party, PDP, the senator will not be eligible to contest the February 25 general elections in Enugu east senatorial zone.

The constitution is clear that a candidate of an election must belong to a political party. The Supreme Court in plethora of cases have stated that it is the political party and not candidate that wins election.

In Wada v. Yahaya Bello (2017) the Apex Court reiterated and upheld its earlier position in Amaechi vs Omehia case when it held that;

โ€œA political party is an abstraction. It has to canvass for votes through its members as agents, in the same way it contests, wins or loses elections through a candidate it nominates who acts as its agents. There is no provision for independent candidates. The candidates nominated to contest at an election by his party acts as an agent of his party. He is, as it were, an agent of a disclosed principal and as far as third parties are involved, benefits and liabilities accruing to the candidate (as agent) belong to his party (the disclosed principal).โ€

In February 2022, INEC declared the APC as the winner of the chairmanship election conducted in Abaji Area Council of Abuja but due to a legal tussle over the partyโ€™s aspirant, no candidate was declared the winner of the election. The INEC Returning Officer for Abaji Area Council said that it would not be legitimate to declare any of the aspirants as the winner of the election. He announced that, โ€œWe cannot declare a candidate winner in Abaji because the winning party (APC) does not have a candidate here, the case is still in court.โ€ He said that a winner would be announced after the resolution of the pending intra party dispute by the Supreme Court. Up till now, the winner of the election has not been declared as the case has not been determined.

The implication here is that since PDP has expelled the candidate it submitted to INEC in Enugu east senatorial zone, the party has lost the opportunity to substitute him because the window of substitution has closed.

Chimaroke Nnamani can not also stand for the said election on February 25, 2023 since PDP can no longer sponsor him in the election.

A combined reading of Section 221 of the 1999 Constitution will help us more as it relates to the pronouncements of the Supreme Court in Faleke v. INEC (2016).

The Supreme court held that it is the political party that stands for election, that votes scored in election belong to the political party and that the candidate nominated to contest at an election by his party acts only as the agent of his party.

Therefore, any vote casts for PDP or Senator Nnamani on February 25 is a waste. By that expulsion, the party has forfeited its right to participate in the February 25 election in Enugu east senatorial zone.

Even though the party can not withdraw his nomination, it is concluded that as at the time of the election, 'candidate Chimaroke Nnamani' does not belong to PDP or any other political party and can not be declared winner with votes cast for PDP.

2023: You Have No Role In Ebonyi, CP Tells Ebubeagu

Ebonyi State Commissioner of Police, Garba Aliyu, yesterday told operatives of the Ebubeagu Security Network that they have no role in the election campaign in the state. He said the Network was not created for political purposes but to complement the security architecture of the state with state actors.

The Police Commissioner stated this in Abakaliki, the state capital, in a meeting with the Resident Electoral Commissioner in Ebonyi, stakeholders of political parties and council chairmen. He warned political parties against engaging Ebubeagu security operatives for any reason.

โ€œThe South East Security Outfit (Ebubeagu) has no role in election campaign and they are not created for anypoliticalpurposes, rather they are to complement the security architecture of the state with the state actors. โ€œTherefore, no LG chairman or political party stakeholders should engage the Ebubeagu, bearing arms of whatever calibre for whatsoeverreasonasEbubeaguwas not created for their political aggrandizement, rather they are to strengthen security of the state as non-state actors. โ€œAnyone found wanting will be dealt with accordingly. As such, LG chairmen and all political stakeholders, including aspirants, are hereby warned and reminded that no one is above the law and anyone who goes contrary to the provision of the extant laws shall be arrested and prosecuted accordingly.

โ€œThe provision of electoral Act 2022, section 91, has ex-presslyprovidedthat onlythe securityagenciesshallhavea role to play in electioneering processasitrelatestoconduct of politicalralliesand procession. โ€œThe Commissioner of Police in each state of the federation and the Federal CapitalTerritory, Abuja, shall provideadequatesecurityfor proper and peaceful conduct of political rallies and processions in their respective jurisdictions. Suit Seeking To Sack President Buhari To Be Delivered Monday
Federal High Court sitting in Abuja is set to deliver a landmark judgment on Monday, January 30 in a suit seeking the removal of the President, Major General Muhammadu Buhari (retd.), from office over alleged illegalities in the 2019 presidential election.The judgment billed to be delivered by Justice Inyang Ekwo would also resolve a request seeking to stop the conduct of the 2023 presidential election scheduled for February 25.A notice for the judgment delivery just sighted on Friday by journalists at the Federal Ministry of Justice in Abuja indicated that the verdict would be handed down by 9 am by Justice Ekwo.The notice was directly served on the Attorney General of the Federation and Minister of Justice, Abubakar Malami (SAN) as the Chief Law Officer of the Federation for President Buhari.

The Central Bank of Nigeria (CBN) has announced a 10-day extension of the deadline for the use of old naira notes across Nigeria.

The CBN governor, who spoke to journalists Sunday morning, said he had the approval of President Muhammadu Buhari for the extension.

The new deadline is now 10 February instead of the former 31 January deadline, he said.

Mr Emefiele spoke in Daura, Katsina State, after a meeting with the president who is in his home state for official duties.

Mr Emefiele said Nigerians, who are yet to change their naira notes from the old to new ones, now have an opportunity to do so.

He said people must utilize the opportunity because the deadline will not be extended again.

PREMIUM TIMES reported how the CBN last October introduced redesigned 200, 500 and 1000 naira notes and gave a deadline of 31st January for the use of the old notes.

However, the new notes have been scarce, thus leading to calls for an extension.

In the judgement, the judge of the Federal High Court in Abakaliki, Justice R.O Riman said that Hon. Victor Chukwu who held the ticket of APC for the Ezza North West state constituency should pay the sum of N500,000 to Barr Leonard Igboke for wasting his time and the sum of N250,000 to others who were interested parties in the litigation.

Barr Leonard Igboke approached the Federal High Court to give him a judgement against Hon. Victor Chukwu who was a 2nd term member of the Ebonyi State House of Assembly and APC House of Assembly candidate on the ground that Victor, in accordance with the court judgment sacking 16 members of the Ebonyi State House of Assembly in March, 2022 for defecting to APC from PDP, and with the swearing of affidavit by the 16 sacked members of the House that they're still PDP members at the Appeal Court.

The 16 House of Assembly members which the APC governorship candidate, Francis Nwifuru was a member and Speaker, approached the Court of Appeal with a sworn affidavit stating that they're PDP members and not APC members. The Appeal Court is yet to pass a judgment on the matter. Barr Leonard Igboke then approached the court with a copy of the affidavit and asked to be declared APC House of Assembly candidate since Victor and his colleagues swore affidavit validating their membership of the PDP and which is yet to be determined.

The court today affirmed the PDP membership of Hon. Chukwu and therefore, returned the ticket to Barr Leonard Igboke.

This will be the fate of the APC governorship candidate in Ebonyi State in a matter of weeks.
