Note the headline states "purported", because 26 U.S. Code § 471 is specific in the methodology by which businesses must account for its COGS, was passed after Code § 280E, and in January 2021 the IRS passed another regulation stating that anyone subject to 280E can't use 471(c) to reduce the impact of 280E. Thus, there is no loophole. It is the law. If you are being told otherwise, you are being misguided and putting yourself, your business, and your wealth at substantial risk.

Find a trusted advisor in a DOPE CFO Certified Advisor to help you protect your business by getting your accounting accurate, GAAP compliant, and audit ready from seed through tax return.

There are two tax codes that are imperative for every cannabis business: 280E and IRC 471.

🌱 280E prohibits cannabis companies from deducting business expenses.
🌱 IRC 471 classifies which costs can go into inventory [and what cannot be allocated as an inventoriable expense]. If done correctly, you can help lower your taxable income!

I've spent my career in highly regulated & politically-charged industries and intend to bring that expertise to my cannabis clients.
