The Difference between the Certificate of Title versus Tax Declaration in the Philippines

CERTIFICATE OF TITLE
1. A document evidencing a right of ownership to a property
2. A document that attest to the fact that the person named is the owner of the property described therein subject to liens and encumbrances noted on it
3. It is registered with the Register of Deeds of the province or city where the land is located
4.The Certificate of Title is indefeasible and imprescriptible
5. All claims to the land are quieted upon issuance of this document
6. Recorded with the Register of Deeds of the municipality, city, or province where the land is located.

TAX DECLARATION
1. A document that show good sign of possession only in the concept of owner, not ownership
2. Not conclusive evidence of ownership to property, but only a proof of payment of realty taxes
3. Recorded with the Assessor’s Office of every municipality or city where the land is located

Ang pagmamay-ari ng lupa ay napapatunayan sa pamamagitan na hawak na titulo na kung tawagin ay ang Transfer Certificate of Title (TCT) o Condominium Certificate of Title (CCT). Ayon sa maraming Supreme Court decisions “the best proof of ownership of a piece of land is the Certificate of Title” (Halili vs. Court of Industrial Relations, 257 SCRA 174 [1996]). Ito ang tinatawag na titulo ng lupa at wala nang iba pa.

Ang "tax declaration ay hindi titulo ng lupa. Maraming Supreme Court decision din ang nagsasabi na "Tax declarations and receipts are not conclusive evidence of ownership. At most, they constitute mere prima facie proof of ownership of the property for which taxes have been paid. In the absence of actual, public and adverse possession, the declaration of the land for tax purposes does not prove ownership." Ibig sabihin nito na ang tax declaration ay hindi siguradong ebidensiya ng pagmamay-ari ng lupa. While tax declarations and receipts are not conclusive evidence of ownership and do not prove title to the land.

Ang tax declaration ay pwedeng i-apply para maging titulo. May dalawang pamamaraan ng pagpaparehistro ng lupa, ito ay ang sumusunod:

1. Judicial Proceeding – kung saan kinakailangan ninyong magfile ng petisyon para sa registration sa korte.

2. Administrative Proceeding –ito ay pamamaraan kung saan mag-file ng application para sa “Homestead Patent” sa DENR at ang registration ng patent na ito ang magiging batayan para sa pag-isyu ng Original Certificate of Title alinsunod sa Commonwealth Act 141 o ang “THE PUBLIC LAND ACT”.

Under the Implementing Rules and Regulations of RESA, real estate service practitioners include “Real Estate Salespersons.”

A real estate salesperson is referred to as: a duly accredited natural person who performs service for, and in behalf of a Real Estate Broker who is registered and licensed by the Professional Regulatory Board of Real Estate Service (PRB-RES) for and in expectation of a share in the commission, professional fee, compensation or other valuable consideration.” [Rule I, Sec. 3-g (5)]

No examination is required by real estate salespersons under RESA LAW, but as a minimum requirement, the applicant must possess these qualifications:

✅ Filipino citizen;
✅ Must have completed at least two (2) years or 72 units of college education;
✅ Must be of good moral character and must not have been convicted with any crime involving moral turpitude; and
✅ Must have undergone training and seminars of at least twelve (12) credit units in real estate brokerage.

The following documents shall be prepared and submitted by the applicant Real Estate Salesperson:

✅ Original and photocopy of NSO Birth Certificate/Certificate of Live Birth.
✅ Original and photocopy of NSO Marriage Certificate/Contract (for Married female only)
✅ Original and notarized certificate of educational attainment on the completion of at least two (2) years of College.
✅ Original NBI clearance (valid).
✅ Original and notarized certification of twelve (12) credit units on Real Estate Brokerage.
✅ 1 x 1 photo on white background, with name tag below showing complete name.
✅ Community tax certificate (CTC) for the current year.
✅ Duly accomplished application form.

Following are the steps to be taken when applying as real estate salesperson at the Professional Regulatory Commission (PRC):

✅ Submit the filled-up or accomplished application with documents for pre-evaluation to the Office of the Secretary, PRBs or of the Assistant Secretary, PRBs at the PRC Central Office, and the Regional Office processing counters.
✅ Proceed to the cashier, for payment of fees Php600.00
✅ Proceed to the Customer Service Center for metered documentary stamp.
✅ Submit duly accomplished application form to the Office of the Assistant Secretary, PRBs.
✅ Verify the status of application at the PRC website: www.prc.gov.ph.

All registered and accredited real estate salespersons shall be issued identification cards and such registration shall be renewable every year on the real estate salesperson’s birth month.

Principally, real estate salespersons are under the direct supervision and accountability of a real estate broker. As a sub-agent under the agency of a licensed real estate broker, the following are the limits and restrictions of the practice of a real estate salesperson:

Real estate salespersons cannot by themselves, become signatories to a written agreement involving a real estate transaction unless the real estate broker who had direct supervision and accountability over them is also a signatory thereto.

No real estate salesperson, either directly or indirectly, can negotiate, mediate or transact any real estate transaction for and in behalf of a real estate broker without first securing an authorized accreditation as a real estate salesperson for the real estate broker, as prescribed by PRB-RES.

A real estate broker shall be guilty of violating the new real estate law for employing or utilizing the services of a real estate salesperson whom he/she has not secured the required accreditation from PRB-RES prior to such employment.

No salesperson shall be entitled to receive or demand a fee, commission or compensation of any kind from any person, other than the duly licensed real estate broker who has direct control and supervision over him, for any service or work done by such salesperson in any real estate transaction.

What many seem to ignore is the vital role that real estate salespersons contribute to the well-being of the real estate business and industry. The unsung heroes of real estate are thrust in the background of the real estate service practice simply because their functions and responsibilities in real estate world are not given much importance.

With the enactment of the REAL ESTATE SERVICE ACT (RESA), real estate salespersons’ role and function in the real estate industry is given more life. This is because they shall be accredited, given recognition and are required to have their own professional licenses as real estate service practitioners by the PRB-RES and PRC.

What is the nature of the job of a real estate salesperson? The new set-up under RESA and the real estate service practice calls for licensed real estate salespersons to be under a registered real estate broker. The broker will employ the real estate salesperson in his office and the company that is established, gives support in the salesperson’s undertaking and is obliged to supervise the activities and transactions entered into by the real estate salesperson in his employ. In return, the employed salesperson share in the income received by the real estate broker.

Almost all real estate salespersons are paid on commission (professional fees) basis, which result either from property and listings they sell or projects that they market. The essential point in his job is the undertaking that selling real estate depends on producing tangible results, that is, from sales generated. One of the real attractions of the occupation is that you can pursue your career in a manner that is compatible with your own interest, personality and values. Herein lies the challenge of the task.

As a start, the real estate salesperson should chart his career in real estate if he intends to be successful in this field. Success in real estate or any endeavor for that matter, does not come easy and in a short period of time. It takes years, lot of hard work, unending sacrifices, even frustrations, disappointments, and the need of continuing challenges to improve one’s craft. Financial rewards come from it and afterwards.
