The Colorado Supreme Court found Trump to be an insurrectionist not eligible to be president again pursuant to the 14th Amendment of the Constitution. Trump appealed and the Supreme Court of the United States held an oral argument on the matter on February 8. Based on that it looked to most observers like Trump would win and quickly.

But more than two weeks have passed, so the ruling won’t be quick and maybe not for Trump. One argument that seemed to impress the Justices was the claim that kicking Trump off the ballot would divest Congress of its right to grant a waiver so that an insurrectionist could serve. But the argument is bogus, because nothing prevents Congress from granting the waiver now or if the Colorado decision is sustained. In fact, sustaining it would put the ball in Congress’s court where it belongs as a political question.
