Regarding real estate commissions lawsuits: There appears to be a discrepancy between the narrative put forth by the plaintiff’s counsel, specifically Missouri attorney Ketchmark, and their subsequent actions.

Ketchmark has previously asserted that the anti-competitive policies of NAR have resulted in “HUNDREDS OF BILLIONS OF DOLLARS IN COMMISSIONS.” However, the trajectory based on recent settlements averaging $69,000,000 suggests a total of ~$345,000,000 if the remaining parties agree to similar terms.

From this, legal fees could potentially amount to 40%, or $138,000,000. This would leave $207,000,000 to be distributed across an estimated 46,000,000 transactions, equating to a mere $4.50 each.

Given this scenario, many within the real estate community are urging the plaintiffs’ counsel to adjust their contingency fees to 4.94%, aligning them with the average real estate commission rates.
