Important update! OMMA, Metrc and plaintiffs reached an agreement on the seed-to-sale lawsuit. That means licensed Oklahoma medical ma*****na businesses have until May 26 to comply with the Metrc seed-to-sale tracking system. We'll be sharing details and scheduling online educational seminars soon. This is a crucial step toward cracking down on bad actors, and providing an opportunity for licensees who follow the rules to thrive.

FOREIGN INVESTMENT/INTEREST DISCLOSURE UPDATE!!! Please like and share. As I discussed last night, HB2272 requires EVERY MEDICAL MA*****NA BUSINESS to file a disclosure form with the OBNDD within 60 days of July 1st. Failure to do so, according to the law, is immediate termination of licensure. I have confirmed with Mark Woodward with OBNDD that OBNDD is on top of it and is working on the form for its website. They will email every MMJ business when itās up and ready. Now is a good time to update your contact info if anything has changed. Please mark your calendar and make sure you get this done when available. Thatās my free PSA for the day.

FOOD SAFETY STANDARD BOARD DISBANDED WITH THANKS!!!! I learned Friday that the OMMA agreed to our request to create a new board. The current board served 2.5 years and worked heard in the early days of this program. We all owe them tremendous thanks for their service. Thanks also to the OMMA (Dr. Williams, Nicole Nash, and Cameron Capps in particular) for doing the right thing, and I hope this is a step in a positive direction. Please join me in calling on Commissioner Frye to put serious consideration into broad representation of dispensaries, processors, growers, patients, law enforcement, and other knowledgeable parties on the new board.
Hearing tomorrow in Okmulgee on Metrcās Motion to Intervene. I will go live from the Courthouse with an update. I can that I think in the end this filing by Metrc was a serious strategic mistake. We shall see.

Governor Stitt SIGNED both HB2646 and SB1033 today!!!! I will figure out a time and announce soon a breakdown of everything that passed this year medical ma*****na related. Look for early next week after Memorial Day.
WINNING!!! Senate down, House to go. After it failed yesterday by 5 votes in the Senate, a lot of hard work went in explaining things to the opposition, and this is how things went. Education proved to be key. Dispensary owners, you can breathe a guarded sigh of relief, we got some protections in for the crazy changes to the school definition etc. I will be able to dismiss my lawsuit filed last year to keep the bad stuff at bay, and that makes me smile.
While Paxton had a lot of things to say about me on the floor, without ever mentioning my name, all I can say back is, glad you check out the page. Wish you would think about what I say when I talk about the problems. We donāt want to fight, but we will when necessary to protect this program. As a final and very important note that I say often but given what Paxton said on the floor, feel the need to say again. Please donāt ever be mean to legislative assistants, even theirs. That is never ever helpful! They all work so hard and donāt deserve that, so please, donāt do it. It hurts as opposed to help. We can call and urge our point without cussing people out. That said, letās see what happens in the House.
LAST DAY!!!! SB1033 has some very important fixes related to school distances, certificates of compliance after year one, rights of caregivers to clearly cultivate for patients, letās OTC go after businesses charging patients sales and excise tax that never get paid like they should, allows OMMA and OBNDD to enter into an MOU to work together in enforcement (we know OMMA needs that help), and lots more. It failed in the senate by 5 votes yesterday, but, what will happen today? I hope the drama of yesterday stays in yesterday. Thanks to everyone that helped work the vote yesterday. Headed to the Capitol to see what happenes!!!! The recap of this session in the coming days is going to be epic!!!
Not feeling sorry for myself, but I seriously wonder if anyone other than a very rare few even remotely understand what it has taken to defend medical ma*****na businesses and patients this year in the legislature. I love what I do, but businesses that want to have impact moving forward, Iām going to be calling on you all soon to contribute and make this an easier process. Iām exhausted. That said, SB1033 is on the agenda again tomorrow. Fingers crossed it can get done and we can save the mess that comes if it doesnāt pass. I understand the opposition, but the good far far outweighs the perceived problem. I fight every day for medical ma*****na, and we have to get this done. Fingers crossed. Session ends tomorrow!!! Well, unless there is a veto in which case they could come back. I will have a lot more to say after session recesses. Biting my tongue.

While there are never guarantees in life, HB2646 and SB1033 should both be signed into law from all indications I have. If you have not taken a look, you might want to now. There is another Bill thatās got some juicy stuff in it that may pass as well, but we will have to wait and see on that one. HB2772 already passed and was signed. I will do a live later today to go over the major highlights in that bill.
OMMA FOOD BOARD MEETING CANCELLED!!!! I have just been informed that the OMMA has cancelled the Food Board meeting they intended to call today to try and push new emergency rules. Thanks to EVERYONE that joined in our call to disband the Board and call a new one. Special thanks to those Processors that took the time to send in their acknowledgements. While I have not heard that they intend to disband the board just yet, getting todayās meeting cancelled was a big first step. It is my sincerest hope that OKDH will seriously consider who will be apart of the next board when they do re-form it, and will start listening to Oklahoma patients and business owners in trying to figure out how to navigate the future. We have a great thing going, but there are glaring problems that need direct and immediate attention, and itās my hope a fresh start can finally get things on the right track. It would be amazing if instead of having to fight OMMA about things they would just be open, transparent, and TALK to the community they regulate. Itās long past time for the OMMA to have public forums to hear the voice of the people. I for one would welcome it because frankly, Iām pretty tired of the fight.
As a side note, I have absolutely nothing against the members of the Food Board. Given that it was formed before we even had patients and an industry in Oklahoma, it is my personal belief that it was time to re-evaluate and put together a Board that accurately represents Oklahoma industry, patients, and community leaders. While much of 788 has been dismantled, I for one am glad that this provision remains to allow for us to take this action. Oh, and for those that will inevitably say it. No, Iām not angling to be on the new board, and I would not do it even if asked. I canāt do my job as an attorney, which occasionally calls for me to sue the OMMA, if Iām at the same time sitting on its board. That would be an impermissible conflict of interest. Sad I have to say that for some, but there you go.
LAST CHANCE. Reposting this for anyone that missed it and wants to join the effort. They are trying to call the Board tomorrow for more emergency rules, so the time to act is now.
OMMA PLAYING GAMES!!!! Please help me by liking and sharing. OMMA is about to try and shove emergency rules down everyoneās throat on Monday without any input from anyone but those at the OMMA. Iām posting the email from their attorney Cameron Capps with this post. Notice what time they sent this email, with a plan to call the Board on MONDAY!!! Why would they wait until after 10pm on a Friday? Itās simple, they know they are wrong, and they know I canāt stop them in Court on the weekend. Forgive me, but I lack significant trust in their leadership, and certainly their legal counsel. We called for the disbanding of the Food Safety Standard Board and submitted the signatures of 21 licensed processors. OMMA Attorney Cameron Capps argues that 3 of those are not āoperatingā and he contends thatās a requirement. While I disagree entirely, there is a fun and easy solution to their pathetic argument. WOULD YOU LIKE TO HELP? Letās turn the 21 into hundreds (FYI, we only stoped at 21 because 20 is all that is required). Below is the link to the letter where I asked them to disband. There is an acknowledgement where you can join in our request. PROSESSORS ONLY (thatās what the law requires) Please sign and email the letter and your signature block to OMMA at [email protected] and [email protected] and copy me at [email protected]. PLEASE MAKE SURE TO COPY ME so I have them. TIME IS OF THE ESSENCE. Also, while you are free to let them know your thoughts when emailing, please keep it civil. Letās send the message that we are tired of their games, and itās time they stop and work with industry and patients as opposed to it always being a fight. INSPECTION and HB2272!!!! If you have not read it, you should. Itās not the license cap bill it was, but about inspections and disclosure. It requires disclosure of foreign investment, but it does more than that. There are rules requiring initial inspections of all licensees within 180 days of licensure. That reads to include existing licenses. There are requirements that need to be met if a license is not active in order to keep from losing the license. Please read, and make sure you are covered. It is going to be interesting to see how OMMA handles this inspection requirement given how things have gone thus far. FYI, if you have been lax on compliance, if you are not getting the message already, now is the time to catch up!!! Link to Bill:

1,000 Gram of THC final product batch testing. Processors, itās a lot better than we had. Am I wrong? Can we call that a win? It makes sense to me, but Iām not the expert. Sound off in comments please.
Smell jars required and canāt sell product in smell jars in order to save deli style? This wouldnāt require prepackaged (people seem confused). It would require dispensaries have small small sample jars and that they use those and donāt then sell that flower to patients. Thatās where things are now from the total death of deli style. Dispensaries, what say you?
