VOTING LOCATION CHANGES

There are three new voting locations proposed by the County Clerk and approved by the County Commissioners.

Precincts 14, 15 and 23 move from Ross Center to Avondale Church.

Precinct 38 moves from Westview Elementary to First Brethren Church (Pct 33 remains here as well).

Precincts 55 and 71 move from Yorktown High School to Yorktown YMCA.

After the verdict was returned, Delaware County Deputy Prosecuting Attorney Andrew Ramirez, who prosecuted the case, said “I am proud to announce that a large supplier of counterfeit fentanyl tablets has been convicted of Aiding, Inducing or Causing Dealing a Narcotic Drug Resulting in Death for his role in the chain of distribution of fentanyl in Delaware County. As far as we are aware, this may be the first time that an upper-level supplier has been held accountable for an overdose death related to his distribution network. This marks the 12th drug dealer who has been convicted in Delaware County of Dealing Resulting in Death.”

Man sentenced to 55 years in prison after gas station double murder in May 2021 13/08/2023

Epic failure. I would like to know what the prosecutor’s recommendation was. The prosecutor says justice was served. No it wasn’t. First of all, the 55 year sentence was 10 years less than the maximum for murder. Second, there were two separate victims. The sentences should have been ordered to be served consecutively. The law is pretty clear. The Indiana Court of Appeals has held that consecutive sentences are appropriate where there were multiple victims. Simmons v. State, 999 N.E.2d 1005, 1013 (Ind. Ct. App. 2013). “Whether the counts involve one or multiple victims is highly relevant to the decision to impose consecutive sentences.” Id. (citing Cardwell v. State, 895 N.E.2d 1219, 1225 (Ind. 2008)). That is because “when the perpetrator commits the same offense against two victims, enhanced and consecutive sentences seem necessary to vindicate the fact that there were separate harms and separate acts against more than one person.” Id. (Citing Serino v. State, 798 N.E.2d 852, 857 (Ind.2003)).

This is a travesty of Justice. This is a clear example of what is wrong with our system - A judge who imposes concurrent sentences for 2 killings and a prosecutor who is proud of that sentence. At the very minimum should be serving a 110 year sentence.

Accountability is the touchstone of our criminal justice system - for adult AND juvenile offenders. The juvenile court soft on crime policies of coddling juvenile delinquents has been a miserable failure. Judges who subscribe to the soft on crime hug a thug juvenile programs need voted out of office.

In Indiana, a person convicted of a violent offense must obtain consent of the prosecuting attorney in order to petition for a reduction of sentence. As long as I am Prosecutor in Delaware County, I will not agree to a reduction of a violent criminal’s sentence. Harold "Pookie" Nettles was convicted of the brutal slaying of a mother and her 5-year old child.
