Facial recognition technologies (FRT) have gained increasing prominence within law enforcement agencies (LEAs), playing a pivotal role in functions such as identification, crime prevention, authorization, criminal profiling, and tracking. Their integration into law enforcement operations has the potential to significantly enhance societal well-being and contribute to the broader social good, aligning with the overarching mission of LEAs. Public acceptance of FRT use by LEAs is generally positive, contingent upon these technologies not expanding surveillance practices. However, concerns related to privacy and data protection loom large.

This talks will highlight some initial thoughts on the risks associated with FRT employed by LEAs, with a specific emphasis on the interplay between the General Data Protection Regulation (GDPR) and the proposed Artificial Intelligence Act (AI Act). The pivotal role of biometric data, encompassing facial features, fingerprints, and behavioral patterns, classified as sensitive personal information under GDPR, creates substantial apprehensions concerning individual privacy and data protection. The AI Act, while ostensibly aligning with GDPR principles, introduces complexities in risk management, necessitating a comprehensive approach to address these concerns.

As we navigate the evolving landscape of AI and data-driven technologies, a proactive examination of these risks is imperative before the AI Act’s implementation. This exploration encompasses a spectrum of issues, including data processing purposes, administrative challenges, and potential equality considerations. By addressing these concerns preemptively, we can work towards the responsible deployment of FRT within LEAs, aligning societal benefits with privacy and ethical considerations.

The landscape of liability concerning harm caused by innovative digital technologies – particularly artificial intelligence, and within contexts like online platforms, introduces distinctive complexities that require an examination of the product liability framework. The most pressing issues stem from the immateriality of software, the service dimension of software and platforms, and the ever-increasing value of data as a commodity. The revised Product Liability Directive addresses these challenges horizontally, extending strict liability to software products and related services, as well as introducing liability for harm to data. These represent decisive changes compared to the old framework of EU strict liability law, which are in need of thorough discussion.

Whilst also dealing with broader dogmatic topics, the webinar considers specific use cases in the digital economy. First, we will look at the overall relevance of the revised Product Liability Directive for innovative technology – specifically, considering artificial intelligence software. Further, we will examine how the proposal adapts to the scope of damages, in particular – harm to data. Another central change is the adaptation of the framework to software products and related software services. We will analyse what this implies for the fundamentals of strict producer’s liability which is traditionally oriented around harm caused by physical products. Finally, we will learn more about the implications of the new liability framework for online platforms. As we navigate these terrains, we hope to shed more light on the evolving landscape of liability for harm caused by innovative digital technologies, and the far-reaching consequences it holds for its stakeholders.

Technologies based on artificial intelligence (AI), especially machine learning (ML), and the discussion about the modalities of their regulation are dominating topics in law, politics, ethics, economics and society. AI systems can exacerbate existing problems (e.g. information asymmetries or accountability problems in complex human-machine interactions), but also introduce new ones (e.g. how to deal with new forms of discriminations or autonomous behavior). Accordingly, the question arises how legal rules and frameworks can cope with these challenges.

During the RAILS–KU Leuven CITIP webinar, several authors that contributed to the special issue will discuss the major findings of their analysis and shed light on the most important conclusions.

Colin Crone opens the second panel with a talk on Standardizing Data Quality. He is an expert member of ISO/IEC JTC 1/SC 42 - Artificial intelligence Working Group 2, editor of ISO/IEC CD 8183 - Data life cycle framework, Associate Partner of BSI and Director of IT Konstruct Ltd.

After that Dr. Julian Padget will give us a lecture on Standardizing Explainability. He ist Associate Professor of Computer Science at the University of Bath; Participant in ISO/SC42/WG2 (Data), WG3 (Trust) and WG5 (AI systems), CEN/JTC21 (AI), IEEE P7003 (Algorithmic bias) and a Member of the UN Committee of Experts (Big Data).
