SANCO KWAZULU NATAL ON CONCOURT’S DISMISSAL OF THE DEPARTMENT OF CORRECTIONAL SERVICES’ APPLICATION FOR LEAVE TO APPEAL SCA’s RULING

SANCO KwaZulu Natal is livid by the South African justice system which seems to remove the blindfold of lady justice each time a matter which involves former president of the country and the African National Congress (ANC), now SANCO Provincial Convener, cde Jacob Zuma is before the court. It has become very clear even to the most of ordinary people in the country that the South African courts seem to have a special law for H.E. President Zuma. The KwaZulu Natal (KZN) Provincial Structure held its special meeting on 15 July 2023, Saturday and reflected on this matter.

SANCO KZN is of the view that the ConCourt’s judgement this past Thursday of dismissing the Department of Correctional Services’ application for leave to appeal a Supreme Court of Appeal’s (SCA) ruling that President Zuma must go back to prison does not come as a surprise to ordinary South Africans. In July 2021 President Zuma presented himself to the Estcourt Correctional Centre where he was supposed to serve a 15 months prison term as per the Constitutional Court sentence which found him guilty, even though there was no trial, for the contempt of the Constitutional Court.

This was during a period of Delta-variant-heightened deadly COVID-19, exactly a year after the South African Department of Correctional Services issued a statement that it has released close to 7000 inmates with the target total of about 19000 inmates who stood to be released, which according to the Minister of Justice and Correctional Services was in line with the United Nations advice intended to address overcrowding in prisons thus reducing the COVID-19 infections. In the month in which President Zuma was incarcerated on 13 July 2021 the Department of Correctional Services reported that 58 confirmed cases which were made up of 21 inmates and 37 officials, we
