:Sexual rights and responsibilities
We all have s*xual rights and responsibilities. We all have the right to decide when, where, in what situation, and with who we would like to be s*xual with. However, we don’t have a right to be s*xual with someone if we’re not sure whether they’re into it. We all have the responsibility to make sure that the people we want to be s*xual with actively consent to whatever s*xual activities you do together.
Each and every time you do anything s*xual, ranging from touching and kissing to having any kind of s*x, you must always have the other person’s consent, from beginning to end. People might consent to one thing or a few things, but not to others. People might consent to begin with, and then change their mind. That’s their s*xual right. If you’re not sure whether the other person wants to keep going but you keep going anyway, is not only unethical - it’s a crime. Under the law (and in this factsheet), ‘s*x’ means all types of s*x acts and s*xual touching between all types of people, including ma********on and oral s*x.The laws about consent apply to people of all s*xes, genders, and s*xualities.Sexual consent means only doing something s*xual involved really wants to and are making an active choice to be involved and continue, not because anyone is feeling pressured or unsure.
Knowing about the importance of consent and making sure that it’s present in all s*xual activities is not just useful because it will help you to not get in trouble with police - it will mean that s*x can be enjoyable, satisfying, respectful, and fun - for everyone involved.
Consent is all about free and voluntary agreement which means that for consent to be present, the law says that people must:
Feel safe – being s*xual without pressure, fear, manipulation, or threats;
Understand – being awake and in control, not being so drunk or high that they are not sure about what they or the other person wants, and not having a mental or physical disability that is so severe that it prevents them from understanding what’s going on; and
Be the legal age to consent - 17 or older
How to check for consent
There must be consent throughout the whole s*xual experience and for each and every act. The law is clear that we should never assume someone is consenting. We should never assume that a person is consenting because they have said yes at other times or because of their reputation or the way they act or dress. If we continue to be s*xual towards someone because we assume that it’s ok without checking in with them, or don’t care whether they are consenting or not - this is s*xual assault and can be a criminal offence.
So, how do we check for consent?
People can show s*xual consent by words or actions. Just because someone doesn’t say ‘no’, doesn’t mean that they are consenting. We all have the right to react in different ways. You can check to see whether you’re getting an enthusiastic ‘yes’ from the other person, either by their words or their actions. If you’re not, or you’re getting mixed signals, or you’re unsure, it’s your responsibility to stop what you’re doing. Going on could be s*xual assault.
Some ways to check in could be by asking “do you feel like…”, “what do you want to do?”, “how does this feel for you?”, “what do you like?”, “what makes you feel good?”. You could also check body language: does their body language show you that they’re into it? Are they showing enjoyment? Is their body language consistent with what they say?
Age of Consent
There are laws about not having a s*xual relationship with people under a certain age. This is because the law says that a person must be ‘the age of consent’ or older to be able to legally consent to being involved in any kind of s*x. A person can be charged with a s*xual offence if they are involved in a s*xual act that breaks these laws, even if the young person under the age of consent agreed to be involved. These laws apply even if the people are in a relationship with each other.
What is the age of consent in SA?
The age of consent in SA is 17. This means that it is against the law for anyone to have s*x with someone who is under 17. For example, an 18 year old who has s*x with a 15 year old.
If the older person is in a position of power or authority over the younger person (e.g. a teacher at their school, or their youth worker, step parent, boss, religious leader, sports coach etc.) then the age of consent is 18. This means that the young person must be 18 or older before the law says that they are capable of consenting to that s*xual relationship. If they’re not 18 or older, then the person in a position of power or authority is breaking the law.
What about if one of us is 17 or older and the other is under 17?
Even if you both agree, the law will say that the person who is over the age of consent is breaking the law for having a s*xual relationship with someone under 17.
What if we’re both under 17?
There are a whole lot of factors which effect whether police decide to charge or prosecute someone for having s*x with someone under the age of consent. It’s up to the police to decide what to do, not anyone else. While it is less likely that police will charge two people who are, for example, both 16 and agree to have s*x, if it looks like there may be a power imbalance, or things look more complex, they might still follow through with this.

Len Cloete, the man shot in the head by cop at Muldersdrift lodge has regained consciousness
Netwerk24 spoke to Chantal who is Len's wife. Chantal said Cloete had undergone two operations on his brain and skull, and had been kept in a coma by doctors.
The publication reported that Cloete could respond to his wife’s voice, but at the moment he is paralysed and can’t talk.
Cloete was shot in the head during an altercation with police at the Misty Hills Lodge in Muldersdrift on 13 November.
In a video of the incident that has gone viral on social media early November, Cloete is seen shouting at police. He is naked at the start of the video but later puts on a pair of blue underpants. He then disarms a police officer. Another cop at the scene fires a single shot that hits Cloete in the head. He falls to the ground.
A public prayer session was held for Len Cloete in late November at the Collage Christian Church in Elarduspark in the east of Pretoria.
:Oratile keleku(20) Gets stabbed to death by "Girfriend":
: Family Says Woman Who Murdered Oratile Harrased Him Because Oratile Did Not Want To Be In A Relationship With Her
The family of 20-year-old Oratile Keleketu who was fatally stabbed, allegedly by a woman, on Sunday in Mohlakeng allege she was harassing him.
Keleketu’s aunt Dineo Maselwa said her nephew was not in a relationship with the woman.
“She was apparently harassing him and we were not aware, as boys don’t usually talk. What we hear is ... she wanted a relationship with him .... Oratile didn’t want her.
Community patrollers mentioned they had seen her at night where Oratile went to perform.
“So, she would wait for Oratile outside, a couple of times the patrollers chased her away, asking her what she wants in the early hours. They told us they know the lady and they have caught her three times walking outside. There was a time when she found the gate locked and tried to force it open. Apparently these things have been happening for a long time and we were not aware,” Maselwa added
“On Saturday, he came to my place with my son and his cousin and they were excited. He told me he was going to perform and ... that was the last time I saw him alive. He was excited because they were going to these two gigs,” she said.
“When Oratile got back from his performance, coming home, that’s when he came across the lady who was apparently sitting somewhere with her friends and she saw him ... she confronted Oratile and his brother."
After a heated confrontation Oratile was stabbed. On Sunday, at about 4am, she received a call that he had died.
“When we got there the nurses told us there was nothing, he arrived dead. He was stabbed once close to the heart and he died, that's how we lost Oratile,” she said.
Maselwa said "Oratile was a people's person. That is why everyone is upset by this whole thing. He loved music, he wrote music and used to perform every Friday and Saturday.”.
“We are devastated, Oratile is a child, we were expecting a lot from him. He loved music, he lived music and that is why we supported him when he went to do those gigs. We didn’t expect someone to cut his life short. On the day that we hear about this thing and when you get to the clinic, seeing your child lying there, it is bad. Children are not coping, we need to find them counselling, we can’t cope, because we ask ourselves what is going to happen, how are we going to move on?
Keleketu had passed grade 11 and was preparing to do matric in 2022.
“We fetched his report and he had passed. He said he was going to work hard to pass because he wanted to finish, he was going to do Grade 12.”
Gauteng Police confirmed a 30 year old woman was arrested at about midday on Sunday in connection with the murder of Oratile Keleketu. A murder case has been opened.
