What is Statutory R**e?
The Criminal Law (Sexual Offences and Related Matters) Amendment Act 32 of 2007 reads as follows:
“Section 15: Acts of consensual sexual pe*******on with certain children (statutory r**e)
(1) A person ('A') who commits an act of sexual pe*******on with a child ('B') who is 12 years of age or older but under the age of 16 years is, despite the consent of B to the commission of such an act, guilty of the offence of having committed an act of consensual sexual pe*******on with a child, unless A, at the time of the alleged commission of such an act, was-
(a) 12 years of age or older but under the age of 16 years; or
(b) either 16 or 17 years of age and the age difference between A and B was not
more than two years.
(2) (a) The institution of a prosecution for an offence referred to in subsection (1) must be authorised in writing by the Director of Public Prosecutions if A was either 16 or 17 years of age at the time of the alleged commission of the offence and the age difference between A and B was more than two years.
(b) The Director of Public Prosecutions concerned may delegate his or her power to decide whether a prosecution in terms of this section should be instituted or not”
Everyone has the following Constitutional rights upon arrest for allegedly committing any offence;
1. The right to be informed of the charges on which you are being arrested;
2. The right to remain silent;
3. The right to be informed promptly
a. of the right to remain silent; and
b. of the consequences of not remaining silent;
4. The right not to be compelled to make any confession or admission that could be used in evidence against that person;
Note: Any information uttered and/or willingly given to an police officer may be used against you in a court of law.
5. The right to be brought before a court as soon as reasonably possible, but not later than
i. 48 hours after the arrest; or
ii. the end of the first court day after the expiry of the 48 hours, if the 48 hours expire outside ordinary court hours or on a day which is not an ordinary court day;
6. The right at the first court appearance after being arrested, to be charged or to be informed of the reason for the detention to continue, or to be released; and
7. The right to be released from detention if the interests of justice permit, subject to reasonable conditions.
Always keep in mind that upon arrest, you are only required to tell the police officers your personal information (Full names and surname, Identity Number/Passport Number, Age, Nationality and Occupation) and home address only!
