Updated Critical Skills List 2023
Great news for Candidate Engineers who are registered with a recognized SAQA professional body and individuals graded similarly in occupations featured on the newly released 2023 critical skills list! They will now be eligible for critical skills work visas, as long as they fulfill all other prerequisites. Additionally, it’s important to note that upon receiving the work visa, they may be required to work under the supervision of a qualified professional, where applicable.
Veterinarians and Veterinary Nurses are also now included on the this newly updated critical skills list.

A sigh of relief for ZEP holders as the High Court today released their judgment pertaining to the long awaited ZEP court matter making an order that all ZEP‘s shall be deemed to be valid for the next 12 months and no holder of a ZEP should be required to produce a valid exemption certificate (permit).
Furthermore, the High Court ordered that the Minister of Home Affairs reconsiders his decision and in doing so follow a fair process that complies with the requirements of section 3 and 4 of the Promotion of Administrative Justice Act 3 of 2000 (PAJA)
All ZEPs have been extended to 31 December 2023 allowing those who have not yet applied for a mainstream visa a bit more time to do so.
CHANGES TO VISA AND PERMIT REQUIREMENTS:
On 11 April 2023, the Minister of the Department of Home Affairs issued Immigration Directive 5 of 2023 which:
1. Waives RADIOLOGICAL REPORTS, meaning there is no need to submit a radiological report on a visa or permit application anymore; and
2. Partially waives POLICE CLEARANCES meaning that police clearances are only required from countries where the applicant has resided in for longer than 12 months after the age of 18 years during the last 5 years immediately preceding the date of the intended visa or permit application.
The Department of Home Affairs have released another circular with concessions.
A blanket concession has been granted extending the expiry date of expired visas to 31 December 2023 for foreign nationals who applied for their new long term visas prior to 31 March 2023 and still awaiting the outcome thereof.
Similarly foreign nationals on long term visas awaiting waiver outcomes applied for before 31 March 2023 are granted an extension until 31 December 2023.
Foreign nationals who receiced a short term holiday visa for less than 90 days and have applied for an extension thereof which is still pending by 31 March 2023 would need to leave by 30 April 2023.
