DLR GROUP, previously known as DölbergLumenrock, today announced a major rebranding effort, effective today, to reflect the company’s progression to South Africa’s largest Family and Business Advisory firm. The new brand assets include a new logo, website and other visual communications as well as the repackaging of the organisation’s service offering.

“The vast majority of businesses in South Africa are owned by families and DLR have the unique expertise to provide services on each aspect required by these families, both locally and internationally,” said Pieter Esterhuizen, Group CEO of DLR GROUP.

MERGER ANNOUNCEMENT

We are excited and pleased to announce the merger of the LUMENROCK, Dölberg Fiduciary and Dölberg Wealth groups with effect from 1 October 2017.

Our new group will be known as the DölbergLumenrock Group however we will still trade under our renowned individual brands in the Wealth (Investment and Insurance), Accounting and Fiduciary sectors.

The merger will result in the DölbergLumenrock Group offering even better service to our clients with our combined expertise, experience and workforce of more than 130 employees from 16 offices both locally and internationally.

We will continue to offer our more than 6 000 current clients and all prospective clients the same personal and professional service that they are used to and that we have become respected for over the years.

TAXATION OF OFFSHORE INCOME FOR SOUTH AFRICANS

Summary of tax effect of new tax proposals by Pieter Esterhuizen, CA(SA) TEP RA of LUMENROCK on 25 July 2017

Most of us have seen the news reports about the proposed changes to SA tax legislation w.r.t. the taxation of offshore income of South African tax residents.
The proposal is to also tax all SA tax residents on their salaries earned offshore, amongst others scrapping the 183/60 day rules whereby they would not have been taxed, from 1 March 2019. Tax paid in the offshore country will be deductible as rebate from SA income tax. SA tax it’s residents on worldwide income, based on tax residency, not the source of the income, but salaries earned offshore were exempted within certain parameters untill now.
Please note that tax residency is the important definition in this regard. If someone has emigrated from SA, he/she would already not be a tax resident any more of SA (at least not only SA), but most probably of the country they are living in now. People that have emigrated should rather ensure that their tax residency in SA is cancelled (deregistered for tax in SA), but in certain circumstances that could not be possible or not yet, but if they do earn a salary in another country of which they are tax resident, that salary will only be taxable in that new country and not subject to SA tax also.
For those that have not emigrated (either in process or not planning to) the situation is more complex and one would have to look at what their medium to long term planning is w.r.t. residency in general. The SA Income tax act makes provision for two tests w.r.t. tax residency of which the “ordinarily resident”-test is important here. The ordinarily resident test focuses on the intention of an individual. The phrase “ordinarily resident” has, among others, been found to mean the place to where an individual would naturally and as a matter of course return from his or her wanderings and what his/her intention would be. To assist with determining this, factors like the place where the individual’s personal assets are located, the location of the individual’s business, his actions in this regard the past few years etc. The individual will onIy be able to pass the ordinarily resident test if his/her intention is substantiated through action, eg application for emigration, medium term residency permits in another country, work permits there, few, if any, short visits to SA, personal assets and current home being in another country etc.
If an individual has been living and working abroad (as a tax resident of that other country) and want to return to SA, his tax residency would then obviously revert back to being a SA tax resident and being taxed in SA (with possible exemptions to foreign pensions etc!)
The “ordinarily resident”-test is not an easy test to pass, but can be done with the correct planning and actions of the individual. The facts set out above is a very short summary of the situation and every individual’s situation is different and will have to be looked at and planned differently. Although there are therefore ways to avoid the taxation of foreign salaries for a SA citizen, the above facts cannot be seen as complete and every individual will have to plan his/her situation differently, most definitely preferably together with an experienced tax specialist.
