New UAE labour laws explained: Flexible working hours, paid leaves; 3-year contracts 19/12/2021

๐Ÿ“ฃ New Federal Decree Law No. 33 of 2021,
regulating labour relations,
effective from February 2, 2022:

- 3 years limited term contracts;
- Regulation of part-time work, temporary work, flexible work;
- Regulation of freelance work, Shared job models, Self-employment;
- Condensed working week;
- Prohibition to withhold employeesโ€™ passports and official documents.
- Expansion of leave days range;
- Overtime of not more than 2 hrs in one day, with 25% increased wage. (Exemption for employees on a shift-basis work).

๐Ÿ”˜ 3 years contract:
- a limited (fixed-term) contract, which may not exceed three years and is renewable for a similar or lesser period upon the agreement of both parties.

๐Ÿ”˜ Condensed working week:
- employee can choose to complete his 40 working hours in 3 days instead of one week as per the contract signed by both parties.

๐Ÿ”˜ Shared-job model:
- allows two employees to share the same job and split the pay based on an agreement with the employer

๐Ÿ”˜ Flexible work:
- flexibility to work on a project, hourly, or for different employers while enabling employers to harness different talents and competencies at lower operational costs

๐Ÿ”˜ Leaves to include:
- 3-5 days for mourning leave;
- 5 days for parental leave;
- 10 days for study leave per year (within UAE)

๐Ÿ”˜ Maternity leave in private sector
Increased to 60 days:
- 45 full-paid days;
- 15 half-paid days;
- 30 full-paid days for mothers of infants with special needs;
- Additional 45 unpaid days leave in case of post-partum complications.

๐Ÿ”ธ Responsibilities of the Landlord

Landlords are liable for many aspects of their own property. According to Law No. 26 of 2007 regulating the relationship between landlords and tenants in Dubai (the 'Tenancy Law'), these obligations are:

๐Ÿ”˜ The landlord is obliged to hand over the property to the new tenant clean and in good condition, which allows the tenant full use as stated in the contract.
๐Ÿ”˜ According to Art. 16, unless otherwise agreed by the parties, the landlord will, during the term of the contract, be responsible for the property's maintenance works and for repairing any defect or damage.
๐Ÿ”˜ Art. 17 states that the landlord may not make any changes to the property that would affect the tenant's full use of it as intended.
๐Ÿ”˜ The landlord will be responsible for any defect, damage, deficiency, and wear and tear occurring to the property for reasons not attributable to the fault of the tenant.
๐Ÿ”˜ The landlord is obliged to return the security deposit to the tenant at the end of the tenancy contract if the premise has been left in satisfactory condition and in coherence with the tenancy contract.

๐Ÿ”ธ Virtual Company License

Virtual Commercial City program (VCC) launched by the Dubai Economic Department, enables entrepreneurs and freelancers across the world to start a virtual company in the UAE even if they do not live in the UAE.
That means a person without a residence visa or permit can conduct business in the UAE. He just needs to apply for the Virtual Company Licence.

The allowed legal form for virtual companies is sole establishment/ sole proprietorship (a business that is owned 100% by an individual). The owner will control all of its operations, keep all profits and be liable for debts and financial obligations.

There are several requirements for an individual to get a virtual company license in Dubai:
โ€ข The applicant must not be a resident in the UAE;
โ€ข The owners of virtual companies must be the nationals or tax residents of approved countries.;
โ€ข Virtual companies can conduct location-independent business activities globally in pre-defined sectors which focus on creative industries, technology, and services.

A Virtual Company License does not automatically guarantee bank account in the UAE as well as physical access to the UAE, be it in the form of a business or visitor or resident visa to any of the companyโ€™s partners, directors, or employees. However, Dubai Government authorities are working on a simplified visa process for the holders of Virtual Company License.

๐Ÿ”ธ Will a wife be responsible for the deceased husband's loan?

Under UAE law, the individual who signed the loan application/agreement is the only person accountable for all the debts incurred. A deceased borrower's debts cannot be passed over to the spouse.

The only exception to this rule is if the spouse happens to be a co-applicant on the loan, has signed over a personal guarantee to the creditor, or has issued a security cheque against the loan.
