The European Commission is unlikely to change the current restriction on tattoo inks under REACH until new „hard data“ is available, Ana-Maria Blass Rico of DG Growth said last week amid growing calls for a review. In a petition presented to the European Parliament’s Committee on Petitions on 26 January, tattoo artist Erich Mähnert and former ink manufacturer Michael Dirks expressed concern about the recently ended transition period for the pigments green 7 and blue 15:3.

The petitioners called on the Commission to give industry until January 2026 to find suitable alternatives and on the EU executive to „realistically adjust“ the thresholds under the REACH restriction. Ms Blass Rico, told the meeting that while the EU executive was open to dialogue on how to further help industry, there would be no changes without new data confirming the safety of these pigments.

And any adjustments, she said, would first have to be considered by Echa’s socio-economic analysis (Seac) and risk assessment (Rac) committees.Ms Blass Rico agreed, however, that the restrictions would be enforced unevenly by member states. Echa’s enforcement forum will address this issue, she added, and welcomed further dialogue with petitioners on best practices for a harmonised approach.

German MEP Peter Jahr of the European People’s Party (EPP) supported the petition and said an „obvious“ solution was to extend the transition period. He said the competitiveness of the European tattoo industry would suffer if customers bought their tattoos in other countries.

However, Danish MEP Margrete Auken of the Greens/European Free Alliance disagreed, saying it was wrong for politicians to act as if „we have more knowledge than the experts and the Echa“.

Following the hearing, the committee decided to keep the petition open and wait for an opinion from the Environment Committee (Envi).

We call on the European Commission to extend the transition period for pigments PB15 and PG7 to January 2026. And to make a realistic adjustment to the threshold values in Annex XVII to Regulation (EC) No 1907/2006 (REACH) We claim that the introduction of Annex XVII to REACH has put the European tattoo industry in great difficulty as stocks of REACH-compliant tattoo inks are limited. there is no adequate substitute for pigment Blue15 and no evidence of it having a critical effect when used in tattoo inks. An extension of the transitional period for pigments PB15 and PG7 to January 2026 would give manufacturers sufficient time for analysis!! the differences in regulatory enforcement between Member States is creating distortions of competition. Arbitrariness and chaos currently prevail in the various member states of the EU. Among other things, we demand guidelines for product labeling for manufacturers. We will get a chance to present our case to the European Parliament on Jan. 26, 2023.
