Under Victorian law, you are covered for change of mind when purchasing a property. There are some conditions:
1. Was the property sold privately? If you answer is yes, then you have 3 business days in which you can change your mind and advise the Agent (in writing as well as by phone).
2. Was the property sold less than 3 business days prior to Auction? If the answer is yes, unfortunately you do not have any cooling off period.
3. Was the property sold at Auction? If the answer is yes, unfortunately, again you do not have any cooling off period.
Can I change the settlement date?
We can negotiate with the Seller on your behalf and see if we can come to a mutually favourable outcome. This is where the right Conveyancer is important.
Duty is payable when you purchase property. The rate of duty varies between 5.5% and 6% of the value of the property. For example, for a house worth $1,500,000, you will have to pay duty of $82,500.
The Victorian government is touting the concept of abolishing duty. The theory is that this will allow people to more readily buy their own house. It will help some people who are unable to find suitable rental accommodation. So, fewer people will be wanting to rent.
In order to maintain public revenue, Land Tax will be increased. Land tax is an annual levy on properties. Currently, your Principal Place of Residence is exempt from Land Tax. It is anticipated that Land Tax will be imposed on your PPR.
So, in addition to paying local Council rates and water rates, you will also have to pay land tax on your PPR. This is in addition to utility charges, insurance and maintenance.
It is predicted that all of the States will follow by abolishing duty on the purchase of property and increase land tax significantly.
