Important Update: Changes Impacting Visa Lodgment for Tourist and 485 Visa Holders
With the recent announcements by the Government, individuals holding visitor visas or 485 visas will no longer be eligible to lodge a student visa application effective from 1 July, 2024.
If any students is in this category who intend to apply for a student visa, it is crucial to act promptly.

Temporary Graduate Sc 485 visa changes 1 July 2024
The Department has updated their 'Changes to the Temporary Graduate visa program – proposed 1 July 2024' webpage to add a section titled 'Eligibility for the Temporary Graduate visa prior to the proposed 1 July 2024 changes'.
The new section states that applicants must have completed their qualification and lodged their Temporary Graduate visa application before 1 July 2024 to be assessed under the current sc 485 visa requirements and that any applications lodged on or after 1 July 2024 will be assessed under the new Sc 485 visa requirements.
The Department has clarified that applicants must meet the Australian study requirement and provide evidence from their education provider of the date of course completion, prior to visa decision. The ‘completion’ date means the date on which the academic requirements for the award of the degree, diploma or trade qualification were met and does not include the formal conferral of the degree, such as through graduation (Migration Regulations 1994, regulation 1.15F(2)).
The legislative instruments which bring the proposed changes into effect have not yet been released.

Apply Now, Before its Too Late:
The extended post-study work rights for international graduates commenced 1 July 2023, providing graduates with degrees in select areas of verified skill shortage an additional two years on their Temporary Graduate visa (subclass 485).
The extension has been reconsidered given Australia’s changed economic environment and additional considerations as identified in the Migration Strategy. As such, international higher education graduates will no longer be able to apply for the extension from mid-2024.

Skilled Program Victoria
The Australian Government has allocated 3,300 skilled visa nomination places to Victoria for the 2023-24 program. Victoria’s allocation consists of:
Skilled Nominated visa (subclass 190) – 2,700 places
Skilled Work Regional (Provisional) visa (subclass 491) – 600 places
More information on the 2023-24 program, including eligibility requirements and program dates, will be published on the Live in Melbourne website when available.

From 1 July 2023, New Zealand citizens who have been living in Australia for four years or more will be eligible to apply directly for Australian citizenship.
They will no longer need to first apply for and be granted a permanent visa.
These changes apply to New Zealand citizens holding a Special Category (subclass 444) visa (SCV) who arrived in Australia after 26 February 2001. Protected SCV holders will continue to be eligible to apply directly for Australian citizenship
Work Rights - Student Visa Holders
Unrestricted work rights for student visa holders will end on 30 June 2023. After that date student visa holders must revert to 40 hours per fortnight while their courses are in session.
Until 30 June 2023, all ongoing students as well as new student arrivals and secondary applicants are able to work more than 40 hours a fortnight in any sector of the economy and work before their course of study commences.

Temporary relaxation of working hours for student visa holders The following entities have been approved to access temporary relaxation of working hours for student visa holders.
Parents can now apply for a travel exemption, for travel to Australia from 1st November 2021.
Victoria’s Skilled Migration Program for 2021-22 will open to new Registrations of Interest (ROIs) on 7 July 2021. The Department of Home Affairs has provided Victoria with 3,500 subclass 190 places, and 500 subclass 491 places.
Victoria will be selecting candidates who are currently living and working in Victoria, using their STEMM skills in a target sector.
The major changes to the 2021-22 program are:
The removal of the minimum experience and hours worked requirement.
An increase in the number of target sectors.
Applicants must have STEMM skills and have a Skill Level 1 or 2 occupation. Applicants for subclass 491 nomination may also have a Skill Level 3 occupation using their STEMM skills.
If you submitted a ROI for the 2020-21 program and were not selected, you must submit a new ROI in 2021-22. Further information about the selection process and how to apply is available on our Registration of Interest page.

Subclass 189 NZ Stream - 3 in 5 years income threshold
New regulation amends 3 income years for the previous 4 years that an applicant for an NZ stream Subclass 189 visa must have earned an amount no less than the income threshold, in the five years before the application was made.
One of the income years must be the income year that ended most recently before the date of the application.
The income threshold for the last 5 financial years has been $53,900.
