The state allocations for the subclass 190 and subclass 491 have been released for this financial year and they are significantly lower than what was previously expected.

We can only hope that this is an initial allocation and more places will be released later in the financial year.

In the meantime it will be significantly more competitive for anyone hoping to migrate so the more points the better!

Ministers for the Department of Home Affairs Website 27/04/2023

The Minister for Home Affairs Clare O'Neil announced earlier today that "by the end of 2023 all temporary skilled workers will have a pathway to permanent residency."

It was also announced that "as of July 1, the temporary skilled migration income threshold, or the ‘TSMIT’, will increase to $53,900 to $70,000."

A big announcement from the new Home Affairs Minister. It will be interesting to see how this pathway to permanent residency will be implemented in the coming months.

The WA State Government has released its nomination requirements for the 2022-23 program year.!​

Commencing from July 1st 2022 people residing overseas are now eligible to be considered for Western Australia (WA) State nomination.

The WA Government has also expanded the list of occupations on its Graduate Occupation List.

Further support for international education sector and international students 26/11/2021

Graduate Visas renewals for those left out of Oz and Longer grants for VET and Masters Students!

A further move has been made by the Federal Government aimed at assisting the education sector “roar back”. In a joint press release from the Hon Alan Tudge MP Minister for Education and Youth and the Hon Alex Hawke MP Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs the following details around the ”new visa settings” were provided regarding the Temporary Graduate (subclass 485) -

Current and Former Temporary Graduate (subclass 485) visa holders who have been unable to travel to Australia and whose visa expired on or after 1 February 2020 can re-apply for a new subclass 485 visa of the same duration as their original visa.

The length of stay on the Temporary Graduate visa will increase from two to three years for Masters by coursework graduates and from 18 months to two years for Vocational Education and Training (VET) sector graduates.

Time spent offshore studying online will count towards qualifying for a temporary graduate visa.

Visa changes to support the reopening of Australia and our economic recovery 26/11/2021

A welcome move for anyone from overseas who “kicked-on” DownUnder during the COVID-19 pandemic on a 482/457!

The Federal Government announced yesterday (25/11) that it was making further visa changes to support workers who remained in Australia during the pandemic.

Eligible Skilled Workers particularly in regional areas and in critical industries such as health and hospitality will be able to access a pathway to permanent residency.

The change will benefit potentially 20,000 Existing Temporary Skill Shortage (subclass 482) short-term stream visa holders and Legacy Temporary Work Skilled (subclass 457) visa holders who no longer meet the age requirement. The Federal Australian Government announced today that the borders are opening once again for Students and a number of other temporary visa holders.

We are still waiting for an announcement on when overseas visitors will be allowed back into the state of Western Australia. We expect an announcement will be made that WA’s border will open with the rest of Australia and the world sometime in late January early February.

New exceptions to the bar on onshore applications

A lot of people don’t realise this but if you are refused a visa while onshore in Australia while holding a bridging visa that is in effect, you are effectively prevented from applying for another visa while you are here. The part of the Migration Act 1958 (Cth) that sets this out is section 48.

The Migration Regulations 1994 (Cth) prescribes that only a few visas as exceptions that can be applied for by a person affected by s 48.

As of 30 October 2021 the government has amended this regulation to add a few more visas.

Namely the subclass 190 Skilled—Nominated (Permanent) (Class SN) visa, the subclass 491 Skilled Work Regional (Provisional) (Class PS) visa and the subclass 494 Skilled Employer Sponsored Regional (Provisional) (Class PE) visa.

As a result of this change from 13 November 2021 persons affected by s 48 can apply for these visas while still in Australia.

Although quite a technical amendment in migration law this is massive news and will help many skilled workers stay in Australia!

Potentially good news for Skilled Migrants wanting to move to WA!

The state government recently announced that they have requested an additional 5,000 onshore places from the Commonwealth Government under the State Nominated Migration Program.

If provided this will hopefully help with the skills shortage here in WA.

Good News!

The Western Australian Government has opened up its list of eligible occupations for state sponsorship to include general occupations such as (and not limited to) trades workers, engineers, and hospitality workers.

For the first time in more than three-years a widened list of general occupations has been put on offer for migrants currently working, or who have job offers, within the State of Western Australia. Up until now state sponsorship options in WA were limited only to a list of occupations for international graduates from WA and a general skills list of only medical occupations. While the WA Graduate list of occupations (set out in the Graduate Occupation List), and the list of medical occupations remain (now set out in the Western Australian Skilled Migration Occupation List in - Schedule 1), the new list of 110 occupations (set out in the Western Australian Skilled Migration Occupation List - Schedule 2) will hopefully help attract more skilled migrants to WA.

All applicants must not only meet the visa requirements set out under the Migration Regulations for the Subclass 190 Skilled Nominated Visa and/or the Subclass 491—Skilled Work Regional (Provisional) but must also satisfy the requirements set out for state nomination by the WA Government.
