Tax, Corporate Law & Trusts Update | Are you considered as a Foreign Investor in Australia? If so, new reporting obligations for foreign investors are expected to commence on 1 July 2023.
You should be aware that:
- Interests in a broad range of Australian assets must be registered, including commercial land of any value, business acquisitions and other assets irrespective of whether FIRB approval is needed.
- There are significant penalties for failing to register an acquisition within 30 days of up to 250 penalty units (currently $68,750) per day.
- Foreign investors and their representatives will need a myGovID to use the ATO’s Online Services for registration of interests.
- The ATO proposes to remove access to most of its online forms from 17 June until 26 June in preparation for the new portal.

International students who complete a degree in a skill shortage area will be given an extra two years to stay in Australia after graduation.
Post-study work rights for select degrees in areas of verified skill shortages will be increased from:
• Two years to four years for select Bachelor degrees
• Three years to five years for select Masters degrees
• Four years to six years for all doctoral qualifications.
The Government has also announced an increase to the working hour cap for international students, from 40 to 48 hours per fortnight
Extended post-study work rights for international graduates - Department of Education, Australian Government From 1 July 2023, international higher education graduates with eligible qualifications will be granted an extra two years of post-study work rights. The allowable work hours cap for international students will be increased from 40 hours to 48 hours per fortnight.

Corporate Law update | Australian Company Directors are now required to apply for a Director Identification Number (DIN).
The Australian Government has implemented a modernisation of the register of Directors of Australian companies. Australian company directors are now required to apply for a DIN.
The DIN is a 15 digit identifier given to a director (or someone who intends to become a director) who has verified their identity with the Australian Business Registry Services (ABRS). Directors will only ever have one DIN. It will operate similar to a tax file number.
The cut off dates for applying for a DIN are listed below:
- Existing Directors - by 30 November 2022
- Directors appointed between 1 November 2021 and 4 April 2022 - within 28 days of appointment as a Director
- Directors appointed from 5 April 2022 - Before appointment.
