Is inheritance considered in property settlement after divorce?

💰Inheritance is typically handled on a case-by-case basis and is influenced by the timing of the receipt of the inheritance. If you received an inheritance before or at the commencement of the relationship, it might be considered an initial contribution, and the value won’t be separated from the overall asset pool. If you receive an inheritance during the relationship and use it for the benefit of both parties (e.g. to buy or renovate a home), however, it will be considered a financial contribution and a joint asset. If you receive your inheritance late in a relationship or after it has ended, it may be excluded from the asset pool.

🤷‍♀️ What is in the best interest of the kids?

Separation is a difficult and emotional time for everyone, and it is vital that steps are taken to reduce the impact on children involved.
Most separating parents make their own arrangements for parenting to suit their circumstances. However, in some cases where an agreement cannot be made between the parents, Consent Orders are established in court.

When establishing orders, the main focus is on “the best interests of the child/ren”, as opposed to the parents. Every family is unique, with individual concerns and circumstances to consider in order to reach an agreement. So how are the best interests of a child determined by the court?

The focus when determining the best interests of the children is on safety and their individual needs. Specifically, the court will look at the following factors:

▪️ The safety, of the child including protection from violence, abuse and neglect
▪️ Consideration of the views expressed by the child
▪️ The child's developmental, emotional, cultural and psychological needs
▪️ The capacity of each person with parental responsibility to provide for the child's needs
▪️ The benefit of having a relationship with each parent or other significant people in their life (for e.g. grandparents or siblings), when it is safe for them to do so
▪️ Anything else that is relevant to the individual circumstances of the child

⏰ A question we get asked from people going through separation is "how long do I have to commence property proceedings?"

The answer is if you are married and not yet divorced, there is no restriction on time limits. However, if your divorce is final, you have 12 months from the date of finalisation of your Divorce to commence property settlement proceedings.

It’s a good idea to talk to a Solicitor as soon as you are thinking about separation. Knowledge is power and being armed with the correct information will ensure you know what options are available to you.

🚨 New Legislation 🚨

Starting July 2024, the Crimes Legislation Amendment (Coercive Control) Act 2022 No. 65 will be in effect, recognising coercive control as a criminal offence in NSW. This change marks a significant step forward in the fight against domestic violence.

🔍 What is Coercive Control? Coercive control involves abusive behaviours aimed at controlling a current or former intimate partner, stripping them of their independence and autonomy. This can include physical, sexual, psychological, emotional, spiritual, and financial abuse.

🔒 Key Points of the Legislation:
The new legislation makes it an offence to:
• engage in abusive behaviour with the intent to control or coerce; and
• the adult or other person are or were intimate partners; and
• the conduct is likely to cause fear or serious adverse impact on the victim’s daily activities.

🔎 Abusive Behaviour Includes:
• Threats, intimidation, or violence
• Coercion or control
• Harm to children or pets
• Financial abuse
• Humiliation or degradation
• Harassment or monitoring
• Property damage
• Isolation from family and friends

🏡 How Does Property Settlement Work?

While divorce and property settlement are all generally considered inextricably linked, they are two separate legal processes. As soon as you and your partner separate, you can begin discussing the division of assets. There are a few ways you can go about deciding on property settlement after separation.

🔹Mediation. If you prefer to keep your property settlement out of the courts, you can instead try mediation. You can both seek legal advice to ensure you get the best outcome, but you won’t need to take the matter to litigation unless the mediation is unsuccessful.

🔹Negotiation. Another alternative to litigation is negotiation. It’s a slightly different method of property settlement as you’ll need to enlist the services of a Solicitor. This is an option for those who think mediation may become far too emotionally charged.

🔹If you agree. You can formalise your property settlement agreement by way of consent orders from the Family Court, or you could get a solicitor to draw up a binding financial agreement. It is our recommendation that you document the agreement through Consent Orders which are held at the Family Court. The court will not be included in your negotiation, but this will provide legal evidence of the agreement you come to with your property settlement.

🔹If you disagree… You can apply to the court for financial orders, including orders relating to the division of property and payment of spouse or de facto partner maintenance. The court will use its four-step process to determine the most just and equitable way of dividing assets.

Mediation is a common method of dispute resolution the Courts have been using for a long period of time in order to settle Family Law matters quickly and cost effectively.

The benefits of Mediation:

🔎Efficient – Mediation is likely to produce a quicker outcome than the more formal processes of arbitration or litigation. It should therefore be considered as early as possible after a dispute has arisen.

🔎Affordable – Mediation is often more cost effective than litigation as it requires less preparation.

🔎Manageable – Mediation is particularly appropriate where a dispute involves complex issues and/or multiple parties.

🔎Empowering – Mediation enables parties to have an input into and to control the process, allowing for a more tailored outcome.

🔎Confidential – Information disclosed during the mediation cannot be used later in any court proceedings. Mediation is also useful where privacy and confidentiality are important. Parties are able to preserve these rights without public disclosure. This often leads to more satisfactory outcomes for both parties.

A question we get asked from people going through a separation is “Do I have to tell my ex how much money I have?”

The answer to that is Yes. Both parties are legally obliged to disclose all relevant information to the court, this process is called disclosure. It includes providing financial information such as bank statements, superannuation statements, tax returns, and tax documents. Failure to disclose relevant information could result in a case dismissal, a fine, or being found guilty of contempt of the court.

We know it’s a time consuming and difficult task to pull it all together, however the sooner you are able to do this, the sooner we have a complete picture of your assets and liabilities, which will assist in negotiating the property pool.

Q: Sometimes we get asked by clients “Can I get a divorce in Australia if I am not a Citizen?”

A: To be eligible for divorce in Australia you must be able to answer Yes to at least one of the following criteria:

◾You were born in Australia or have become an Australian citizen by descent (for e.g. you were born outside Australia, however at least one parent was an Australian citizen and your birth is registered in Australia).

◾You are an Australian citizen by grant of Australian citizenship (you will need to provide your citizenship certificate).

◾You live in Australia and intend to continue living in Australia. You must have been living in Australia for at least the last 12 months - evidence must be provided e.g. your passport showing the date of arrival at least one year prior and a valid or current visa.
