How Long Before a Creditor Can Garnish Wages?
The Good News: Most creditors need to get two court orders for a wage garnishment, which usually takes some time.
The Bad News: If you owe money to the government, unlike most other creditors, they can essentially skip these court steps. Canada Revenue Agency does not need a court order to start a wage garnishment, they can issue a “requirement to pay” notice directly to your employer (or to a client if you are self-employed).
Many people don’t learn that a wage garnishment is starting until their payroll department lets them know they have received the notice, giving them little time to react or prepare for this income cut.

Who Will Know if I File for Bankruptcy?
Many people considering bankruptcy are concerned about their privacy, and the good news is that the bankruptcy process in BC is actually quite private.
▪️ In most personal bankruptcies only your creditors, Licensed Insolvency Trustee, and the Office of the Superintendent of Bankruptcy (“OSB”) will be aware of the proceedings.
▪️ Credit bureaus will obtain information about your personal bankruptcy from the OSB and keep this information on your credit history for six years from the date you are discharged (released) from bankruptcy. This does not mean you cannot obtain credit during this time, and during your bankruptcy one-on-one financial counselling sessions will provide you with tools and resources to help you re-establish a positive credit rating.

Can my Spouse and I File a Consumer Proposal Together?
In situations where spouses have debts in common it is possible (and often advantageous) to file a joint Consumer Proposal together.
▪️ It is not a requirement for all debts in a joint Consumer Proposal to be jointly held, but there should be some substantial level of commonality/shared liability for the debts (i.e. at least some debts are in both peoples’ names).
▪️ If both spouses have unmanageable debts but few debts in common, then separate solutions to resolve the financial issues may be more appropriate.
