Human rights law is a foundational area of Canadian law, and it is an important part of our work at Bow River Law LLP. One of our partners and co-founders, Sarah Coderre, has been involved in the Webber Academy human rights case since 2020 as appellate counsel for the Alberta Human Rights Commission before the Court of King’s Bench and the Alberta Court of Appeal.
The decision of the Tribunal stated that two Muslim students had been discriminated against by Webber Academy in 2012 when they were told they could not use quiet places on campus to say their daily prayers, and were then refused re-enrolment in the private school because they continued to pray on campus. Webber Academy appealed the decision several times, including to the Supreme Court of Canada.
Yesterday the Supreme Court of Canada decided that it would not hear Webber Academy’s last appeal, and the decision from the Alberta Court of Appeal, upholding the Tribunal’s decision to award the students damages for discrimination, is now the final word on the matter.
