MYTH: Your criminal record will “Go Away” after some time has passed.

When you are asked to conduct a criminal record check, and “Self-Declare” what is on your record, you must include all convictions, even if they happened when you were younger, or they occurred years and years ago.

A criminal conviction does not “disappear” after a certain number of years have passed. Unless you have received a “Pardon” or “Record Suspension” for the conviction, it will remain on your record.

For example, John Doe was pulled over and convicted with “Driving Under the Influence” at the age of 19. He is now 50 and this happened over 30 years ago. Unless John Doe went through the process of obtaining a “Pardon” or “Record Suspension”, this conviction will appear on the criminal record.

The length of time since the offence, or the seriousness of the offence, has no bearing on the result of your criminal record check.

The Importance of Rescreening Your Employees!

It’s important to rescreen your employees on a regular basis to be sure that things have not happened in their private lives that are, or could be, impacting your workplace without your knowledge.

A lot can change over a couple of years, and so can people. It is important to know who you have working for you, and to ensure you are keeping your workplace and employees safe.

We recommend all employees be rescreened using the “Enhanced Criminal Record Check” every 2 to 3 years. This search will not only confirm any convictions, but will also tell you if your employee has been charged with any offence and is currently awaiting court, has any outstanding warrants, etc.

Rescreening your employees will allow you to see if they have been convicted of pending charges that you may not have known about if you only did a basic criminal check on your applicants when you first hired them.

An example would be….John Doe has a pending “Driving Under the Influence” charge. They may have been hired as a “Driver”, and will be using the company vehicle. If the applicant is eventually convicted and injures someone with your company vehicle, your company could be liable. Is this a chance you are willing to take?

In some cases, employees may have been elevated to a new position requiring more in-depth rescreening and we can help with that too.
