En septiembre de 2021, un tribunal de arbitraje privado poco conocido hizo una interpretación extremadamente amplia del derecho internacional de las inversiones. Si bien el Tribunal encontró que las medidas adoptadas por el país para proteger el páramo fueron un ejercicio legítimo de protección ambiental, este mismo determinó que Colombia había tomado una medida injusta y manifiestamente arbitraria vis a vis de la empresa.
Este caso aún no ha concluido, pero sus posibles implicaciones son inquietantes para la protección del medio ambiente en el país y para otros casos de arbitraje que tienen un componente medioambiental o social en Colombia y a nivel global, dado el efecto escalofriante que podría tener en futuros arbitrajes relacionados a proyectos mineros. Lo que es peor, es que hay muchas otras empresas mineras que están demandando a Colombia y a otros gobiernos de la región por medidas que las comunidades han luchado por muchos años con gran riesgo para proteger sus vidas y sus territorios de los daños de la minería.
Acompáñanos en un conversatorio con tres movimientos de Colombia y Guatemala que resisten a la minería para hablar sobre los peligros y las injusticias del sistema Internacional de Arreglo de Diferencias relativas a Inversiones.

7 Years After Canada's Largest Mining Disaster: Are We Safer?
Please sign and share broadly! 7 years after the worst mining disaster in Canadian history, community members and taxpayers are still not protected from harm. On August 4, 2014, the mine waste dam burst at Imperial Metals’ gold-copper Mount Polley Mine, releasing a catastrophic 24 billion litres of mine waste and contaminated water into the Quesnel Lake watershed, one of the deepest natural fjord lakes in the world, and home to one of the largest salmon runs in British Columbia. Seven years later, there have still been no charges or fines issued against Mount Polley for the disaster. Instead, Mount Polley has received permits to pollute by being allowed a mine wastewater discharge pipe into Quesnel Lake. Concerned Citizen of Quesnel Lake want the pipe removed. They also want the company to pay for a proper water treatment system. The Water Defenders: A Celebration and Reflections on International Solidarity in El Salvador's Victory over Mining
On the 12th anniversary of the assassination of Salvadoran water defender Marcelo Rivera, join activists from Canada, the United States, and El Salvador in a webinar discussion on lessons from North American activists and organizations’ decade-long solidarity relationship with Salvadoran water defenders for international solidarity work going forward. The conversation will draw on the rich history of Canadian solidarity with social movements in El Salvador.
Robin Broad and John Cavanagh, authors of the just-published book: The Water Defenders: How Ordinary People Saved a Country from Corporate Greed (Beacon Press, 2021) will kick off the discussion with observations from the book, which covers the Salvadoran people’s struggle to protect their small, precious country and its imperilled waters from large-scale metal mining. Then, moderator Jamie Kneen of MiningWatch Canada will bring in others for their reflections, including Vidalina Morales of ADES (Asociación de Desarrollo Económico Social, El Salvador), Jen Moore and Manuel Pérez Rocha of the US Institute for Policy Studies, Laura Avalos, founder and former president of the Salvadorian Canadian Association of Ottawa and National Capital Region (ASCORCAN), René Guerra, former director of Salvaide, and Jim Hodgson, formerly of the United Church.
