After the court grants a divorce order, and as long as there is no appeal, a divorce can take a total of 31 days.⁠
⁠
The Supreme Court will only grant your divorce in BC if all of the following conditions are met:⁠
⁠
1. You (or your spouse) have lived in BC for a year or more⁠
2. You can demonstrate that your marriage has broken down⁠
3. The court is satisfied that you have made reasonable arrangements for any children, including child support⁠
4. You can apply to the court for a divorce any time after you separate – the court will not grant a divorce until you have been separated for at least one year.⁠

One of the first cases under the new legislation has ordered a New West couple to share ownership of their golden retriever!⁠
⁠
The case involves a couple who were together for about three years. Near the beginning of the relationship in 2020, they purchased the pet. The wife was seeking custody when they split up. The judge took into consideration receipts/vet bills during the time they both owned the dog and the love/care they both showed to the animal. 🐶 It was ruled that the splitting couple should share the custody of their dog 50/50, on a week-on, week-off basis. In B.C. pets are now considered part of the family, rather than objects, allowing for custody agreements. ⁠
