Joint tenancy is where two or more people own a property together, jointly and equally. The key principle of a Joint Tenancy is the right of survivorship which means that in the event of a death, the property can easily be transferred to the surviving owner. However, there are certain exceptions to this rule, particularly when a spouse owns the property with someone other than their spouse and it is their matrimonial home.

Provided that an Assignment clause is contained in your Agreement of Purchase and Sale, you are allowed to Assign your property, if you wish to do so. Although it is more common for pre-construction properties, you can assign both a pre-construction as well as a resale property.

Law Society update - Reinstated requirements for virtual verification of client identity as of January 1st, 2023
The Law Society is ending a COVID-19 pandemic emergency measure that allowed virtual verification of client identification without authentication. As of January 1, 2023, licensees will be required to verify client identity in-person using the government identification method that was in place prior to the pandemic, or methods that do not require that they be in the presence of the client, including virtual verification with authentication.
This change realigns virtual verification requirements with the requirements detailed in Part III of By-law 7.1.
The By-law provides two methods of verification that do not require licensees to meet in-person with clients — the credit file method and the dual process method. Licensees may also continue to use an agent to verify an individual’s identity.

As of October 25th, 2022, the Non-Resident Speculation Tax (NRST) has increased to 25%. The NRST applies in addition to the general Land Transfer Tax.
