Today, the International Court of Justice (ICJ) ruled on a case referred to the court by the UN General Assembly in December of 2022 on the question of the occupation of the West Bank and Gaza, the ’67 territories of Palestine. The court ruled emphatically that this occupation was illegal. The court further ordered Israel to end the occupation of the West Bank, Gaza, and East Jerusalem “as rapidly as possible”, to return Palestinian land and pay reparations, and to remove its settlers from these areas. It called upon the UN and all countries of the world to respect this ruling, to refuse to recognize or support the illegal occupation, and reject Israel’s efforts to alter the demographic composition of these parts of Palestine.

While this opinion is limited to the ’67 territories of Palestine, the Palestinian people’s right to self-determination is not. Today, the court affirmed that right, underscoring what our people have been demanding for over a century. This decision accelerates the isolation of the Zionist entity — and its Western backers — from the rest of the world.

The decision shows the power of our movement, in that the highest international court of law is recognizing the occupation as illegal. At the same time, this decision lacks enforcement power. As in the case of South Africa’s emergency petition under the Genocide Convention, the court relies on complacent UN bodies to enact its decision. Palestinians understand the futility of international law, and that our people’s resistance will always be the tip of the arrow in our struggle.

Our growing movement must continue to unmask imperialism and a world order that allows this genocide to continue. This decision widens the cracks in the armor of empire, and we must strike at Zionism wherever it is exposed. It is our movement, rather than any court opinion, that will ensure the downfall of the occupation.

Statement by Dr.Mustafa Barghouti, the secretary General of the Palestinian National Initiative:

The ICJ decisively concluded that the whole of the West Bank, East Jerusalem, and Gaza Strip are parts of the Palestinian Occupied Territories and negated any Israeli claim that they are Jewish or disputed territories.
The court decided that the Israeli presence, including the military occupation and Israeli settlements are illegal and should be removed as soon as possible.

The court confirmed the applicability of the Fourth Geneva convention to the Palestinian Occupied Territories.

It affirmed that the Israeli occupation of West Bank, East Jerusalem, and Gaza Strip is illegal and must end.

It also confirmed the illegality of all settlement building in the West Bank and East Jerusalem and declared that the Israeli annexation of East Jerusalem and any part of the Occupied Palestinian Territories is illegal and must be reversed.

It confirmed that Israel is practicing racial segregation and apartheid against the Palestinian people.

It also obliged Israel to pay compensation to Palestinians for all the damage or harm it caused including house demolitions and land confiscation.

The ICJ ruled that the UN and all countries should not recognize the Israeli de facto illegal measures in the Occupied Territories and must work to end the Israeli illegal presence in the Palestinian Occupied Territories.

Israel’s attack on the ICJ and its claim that it is antisemitic will not change the legal facts that Israel is in violation of international law and is acting as a pariah state.

Injunction rejected!!!

The pro-Palestinian encampment on McGill University’s downtown Montreal campus can stay, that’s according to a Quebec judge’s decision on Wednesday – rejecting the school’s provisional injunction request to dismantle it.

CBC: Quebec Superior Court judge rejects McGill injunction request to remove encampment

A Quebec Superior Court judge has rejected a provisional injunction request by McGill University to remove pro-Palestinian encampment activists from its front lawn in downtown Montreal.

Justice Marc St-Pierre said in his decision issued Wednesday morning that the university failed to justify the urgent need to dismantle the camp.
