‼️Important Notice: Deadline for Payment of Taxes Extended for 60 Business Days starting from 19th of August 2024.

According to the Decree no. 32/2024 issued by the TRNC Council of Ministers and published in the Official Gazette on 15th of August 2024, the vendors and foreign purchasers who have obtained permission to purchase, but have not been able to take the title deeds due to separate title deeds not being issued, are granted further 60 business days starting from 19th of August 2024 to settle their taxes. These taxes include the Transfer Fee, VAT (if applicable), and Stoppage Tax.

The payment of the Transfer Fee at the rate of 6% (for those who has their contracts registered after 10th of February 2023) or 12% (for those who had their contracts registered before 10th of February 2023) and 5% VAT (if the vendor is professional) are the responsibility of the purchaser, while the vendor is responsible for paying the stoppage tax at a rate of 2.8% or 4%(if the Vendor is professional).

The Tax Office and District Lands Office have introduced a procedure that allows for the payment of taxes on the condition that, once the separate title deeds for the properties in question are issued, title deed will be issued directly in the purchaser's name.

To proceed with the payment of the above-mentioned taxes, an application together with a copy of the contract of sale and Council of Ministers decision have to be lodged with the District Lands Office, and upon valuation being approved by the Valuation Department, the payment of the taxes will be made accordingly.

Compensation Payments by the Immovable Property Commission - April 2024 Update

The Immovable Property Commission (IPC) was set up, under law 67/2005, to provide remedies for properties that had to be abandoned by Greek Cypriots in northern Cyprus, pursuant to the events of 1974.

The IPC has been in operation since then and is a body that is recognised by the European Court of Human Rights, as a judicial mechanism that offers effective domestic remedies.

There has been a noticeable increase in the activities of the IPC in recent years, particularly in 2023. The IPC has been issuing awards in relation to claims made by Greek Cypriots at a much faster pace than before.

✔️Financial Solutions: Funding IPC Compensation Payments

One of the problems that was being faced regarding IPC applications has been the lack of funds to pay compensation to the Greek Cypriots applicants. In the beginning of 2023 the Turkish Cypriot administration made an amendment to the property transfer taxes paid at the District Lands Office in northern Cyprus. In accordance with the amendment to the legislation, transfer taxes were increased and a percentage of the taxes is now directed to a fund that is used to pay Greek Cypriots that have been awarded compensation by the IPC.

✔️GBP 12 Million Disbursed: Successful Settlements for Greek Cypriot Applicants in 2023

As a result, according to the IPC, in 2023 a total of GBP 12,000,000 (twelve million British pounds) was paid to settle 32 applications made by Greek Cypriots. Funds continue to flow into the budget line dedicated to compensation for Greek Cypriots and payments are being made regularly.

✔️Turkish Cypriot Administration's Support for IPC

In recent months Turkish Cypriot authorities expressed on several occasions their commitment to ensuring that the Immovable Property Commission remains an effective domestic remedy, as acknowledged by the European Court of Human Rights. It is expected that in the coming period applications to the IPC will be concluded and compensation payments will be made at increasingly faster rates.
The Prime Minister has recently made the announcements that GBP 68,000,00 ( sixty eight million British pounds) will be paid for approximately 200 applications that have been finalised by the IPC.

IMPORTANT ANNOUNCEMENT

As of 7th of February 2024 the transfer tax at the rate of 12% will be applicable to all purchase transaction regardless of when the contract of sale was registered at the District Lands Office.

The exemption for those who had their contract registered before 10th of February 2023, would pay the transfer fee at the rate applicable in 2022 (i.e. 3% or 6%) HAS BEEN ABOLISHED.

Under the current regulation, foreigners who are in the process of obtaining the title deed in their names and whether their contract was registered before 10th of February 2023 or not are required to pay 12% transfer tax.

Legalisation of SIGNED foreign documents for use in Northern Cyprus

In order for documents signed abroad to be recognised in Northern Cyprus, they must be certified by a TRNC Representative's Office (see below) OR the Turkish Embassy in the country where the signee resides.

1️⃣Certification by Turkish Embassies

❗️Due to new rules implemented by the Turkish Embassy in Northern Cyprus regarding documents certified by a Turkish Embassy, such documents need to be certified by the Ministry of Foreign Affairs in Ankara before the document is sent to the TRNC. In this respect, the signee will need to engage a lawyer in Turkey to certify the document by the Ministry of Foreign Affairs in Ankara.

Upon arrival to the TRNC documents signed at a Turkish Embassy and then certified by the Ministry of Foreign Affairs in Ankara 🇹🇷, such documents must then be certified in the TRNC in the following order:
1. Turkish Embassy in Northern Cyprus;
2. TRNC Ministry of Foreign Affairs;
3. TRNC Ministry of Interior;

2️⃣Certification by TRNC Representative Office
Documents certified by a TRNC Representative's Office, have to be certified by the TRNC Ministry of Foreign Affairs upon arrival to the TRNC.

Mrs Peyman Erginel had the honor to tell her story of her success as the very first woman advocate in the TRNC at the the occasion of the "40 Entrepreneurial Women in the 40th Anniversary of the Republic".

The event was a photography exhibition that was organized by the “Turkish Cypriot Entrepreneur Women’s Association”, and was held under the auspices of Mrs. Birgül Feyzioğlu, the wife of His Excellency Mr. Metin Feyzioğlu, the ambassador of Turkey.

The exhibition which took place in Bellapais Monastery, displayed the photographs of 40 successful women, who have made a significant contribution to the development of women's entrepreneurship in the Turkish Cypriot community and beyond.

Below are some excerpts from the autobiography of Mrs Peyman Erginel:

❝In those years [late -70s], my foreign clients, especially solicitors from England, said that they had never seen a woman open and run a law office successfully, even in England. They stated that, although there are a few female judges and lawyers in England, they worked under the management of a man who is the head of an institution.❞

❝In the 1970s, Turkish Cypriots were faced with a fatal disease known as "Mediterranean anemia" or Thalassemia. It was not possible to predict when a child would be born sick. The birth of such a child would have devastating consequences for the entire family. All the people were uneasy and lived in fear.

In order to prevent the disease ["Mediterranean anemia" or Thalassemia] which Turkish Cypriots face], in 1970s, efforts to establish the "Association for the Protection of Thalassemias" began. I participated in these activities. I prepared the charter of the "Association for the Protection of Persons with Thalassemian". After the association was established in 1978, I also ensured that the necessary amendments were made to the Family Law, obliging the couples intending to get married to take tests to be aware of the risk for their children of being born with Thalassemia.. Thus, the necessary precautions were taken to stop the disease.❞

💼 COMPANY INCORPORATION IN NORTHERN CYPRUS (TRNC)🏝

In order to conduct any kind of business in the north of Cyprus, a local company🏢 has to be incorporated. The law of Northern Cyprus provides prosperous conditions for foreign investors to conduct commercial activities in many sectors. ‼️ Although there are certain types of business activities that may require foreign investors to partner with Turkish Cypriot citizens, it does not always restrict foreigners to incorporate a company (in alternative sectors) without a Turkish Cypriot partner.

PRIVATE LIMITED COMPANY (LTD) IN NORTHERN CYPRUS
Under the Companies law of the TRNC, foreign investors who intend to conduct business in Northern Cyprus can operate in the local market only through LIMITED COMPANY (LTD) with a minimum capital of 💶 25,000 euros.

The incorporation process of a limited company in Northern Cyprus is regulated under⚖️ Cap. 113 Companies Law. The shareholders of a limited company only hold responsibility which is equal to the shares owned. In this respect, if there is any debt or other liabilities of the company, personal assets of a shareholder cannot be followed. However, this is not the case for the company itself. The company has unlimited liability with all its assets for the debts of the company.

There are certain regulations and conditions to be complied with in order to incorporate a company in the TRNC. However, once you engage the services of a 👩🏻‍💼 qualified lawyer in Northern Cyprus, it will be easier for you to go through the incorporation process.

2023 -New Rate of Transfer Tax (Fee) in Northern Cyprus The transfer tax (fee) has increased till 12%. Foreigners must pay half of 12% transfer fee to register a contract of sale with the TRNC Land Registry.

⚖️On 24 October 2022, the TRNC Council of Ministers passed a law on immigration amnesty (No.25/2022) under Foreigners and Immigration Law.

📌Such an amnesty grants the right of pardon to those who reside in Northern Cyprus despite the fact that their tourist visa has expired or they failed to complete the procedures to obtain a residence permit (Family Residence permit, Short Term Residence permit, Student Residence permit Work permit, Business permit). Furthermore, foreigners who did not extend their expired permits and who were charged with the fine can also benefit from the said amnesty.

Therefore, as of the 27th of October, 2022 everyone who illegally stays in the TRNC can apply to the Immigration Department of Northern Cyprus to legalize their immigration status. The Immigration department will evaluate the application within the scope of the said amnesty and if the application is approved, one will be required to pay a fine of a minimum monthly wage within 10 days of approval.

Everyone who was been residing or working in the TRNC without permission and was banned from entering Northern Cyprus can enter the TRNC within 90 days (until 26th January 2023) and pay a minimum monthly wage upon entry to Northern Cyprus.

Once the fine is paid, the person will be given 60-days of Tourist Visa. During that time, the person is required to apply for a residence permit or leave Northern Cyprus.

⏳The amnesty law is effected for 90-days from the date of its publication in the TRNC Official Gazette.

Therefore the application for the amnesty has to be made before 🗓️26th January 2023.

PLEASE NOTE: Foreigners who have already benefited from the previous amnesty (implemented under the amendments to the regulation with no 18/2021) will not be given the right of pardon.

In April 2022 the British Residents Society (BRS) met with President Ersin Tatar, to discuss the ongoing issues that affect the British community in TRNC. Our advocate, Erdem Erginel Erdem Erginel, was present in the meeting.

At the meeting, which was held at the Presidency, Ersin Tatar emphasized that the BRS is one of the most important associations of the expatriates in TRNC. He also expressed his admiration for the work BRS has done and continues to do, ranging from health to charity work.

The main purpose of the meeting with President Tatar was to discuss the main issues that are faced by British expatriates in the TRNC, i.e. permission to purchase immovable property, care homes for elderly people, residency issues and voting rights.

The representatives of the BRS, the legal advisor, Erdem Erginel, and the President actively discussed the difficulties related to Permission to Purchase immovable property. The BRS collected nearly twenty enquiries from members and non-members which were sent to the Presidency for the purpose of further discussion at the meeting. The basis of all these inquiries where refusal of the permission to purchase as the current or retired members of the army had moved to the area where expats had bought their properties.

As a solution to the aforesaid matter, Erdem Erginel suggested to the President that TRNC should take the example of the army in Turkey. There the military authorities have clearly defined the areas where non-citizens would be refused permission to buy. In this way, a foreigner would know beforehand whether he would be given permission to purchase a specific property. The President said that his staff will inquire with the army about the possibility of introducing such a system in the TRNC.

Another controversial discussion between BRS, legal advisor Erdem Erginel, and President Ersin Tatar was about some residency issues. The BRS explained that there were members who had recently received large fines due to the shortcomings of the Immigration department and that there was no actual process in place for them to appeal against those decisions. In this respect, the legal team of the Presidency will arrange a meeting with a new Minister of Interior to discuss the ongoing immigration issues and to facilitate certain processes as much as possible.

"Bitcoin accepted here💰”: Is the cryptocurrency payment protected by the
⚖️TRNC laws?

Over the past few years, cryptocurrency has become one of the most discussed topics throughout the world. Buying and selling cryptocurrency is extremely popular nowadays, especially in the TRNC. There are ♾ dozens of cryptocurrency exchange points all over Northern Cyprus. Moreover, there are a growing number of TRNC companies 💁‍♂️ that allow customers to use cryptocurrency as a method of payment for goods and services, and even to purchase a
🏡 house in Northern Cyprus.

Despite the wide usage of cryptocurrency in Northern Cyprus, there are ❌ no laws or regulations that would regulate cryptocurrency turnover within the territory of TRNC. Laws of TRNC neither recognise crypto nor forbid it . Hence, all the withdrawals or payments made in cryptocurrency cannot be confirmed by receipt of payment💸 , as such a document can only be issued for the traditional currency. Since the current legislation does not recognize and regulate cryptocurrency operations, the person who makes a payment in cryptocurrency is 🙅‍♂️ not protected by the law.

✅ Recently, the newly established TRNC government announced its intention to prepare the legislation to regulate the use of cryptocurrencies. However, until the legislation comes into force, our advocates at Erginel Law do not recommend making the payment in cryptocurrency because it is not a legally applied method and brings many problems with it, especially when it comes to large transactions.

💢We would like to make an important announcement with regard to 🛂 immigration matters in Northern Cyprus.

The TRNC Council of Ministers has recently posted a ⚖️ law on amnesty under Foreigners and Immigration Law.

✅ Such an amnesty granting the right of pardon to those who overstayed their tourist visa or have not applied for a renewal of the residence permit once it expired, or have been working without a work permit.

Therefore, as of 3rd of November, 2021 everyone who illegally stay in the country can 📝 apply to the Immigration Department of Northern Cyprus to legalize their immigration status. The Immigration department will evaluate the application within the scope of the said amnesty and if the application is approved, one will be required to pay a fine of a minimum monthly wage.
Once the fine is paid, the person will be given 60 days of Tourist Visa. During that time, the person is required to a apply for a residence permit or leave 🛫 Northern Cyprus.

‼️It is essential to note that those who entered the TRNC with a tourist visa and it has expired before 1 January 2020 can not benefit from the said amnesty‼️.

The amnesty law is effected for 90 days since the date of its publication in TRNC Official Gazette.

🗓 Therefore the application for the amnesty has to be made before 1 February, 2022.

WHO CAN CLAIM RESTITUTION (RETURN) OF THE PROPERTIES OWNED PRIOR TO 1974 IN NORTHERN CYPRUS🏠?

In accordance with the ⚖️ Law 67/2005, which establishes the Immovable Property Commission (IPC), a person who owned a property in Northern Cyprus and had to abandon it in 1974 may be 🏆 awarded the restitution of their properties.

The IPC is empowered to offer the remedies of restitution, compensation and exchange in relation to the properties that had to be abandoned in 1974.

So far, the principal remedy offered by the IPC has been compensation. However, under certain conditions, the properties in northern Cyprus may be returned to their owners in 1974:

✅The property is not being occupied by individuals or other legal persons under the laws of the TRNC;
✅The return of the property to the pre-1974 owners does not endanger national security or run counter to public policy; and
✅The property in question is beyond the military zone and does not have installations for military use on it.

In the event that the IPC rules out ordering restitution, it has power to offer alternative property and/or 💸 compensation for the value of the property, as well as compensation for loss of use and non-pecuniary damages.

Taking into consideration the recent moves by the Turkish Cypriot administration regarding the opening up of the fenced-off area of Varosha 🏘, the persons who owned immovable properties there and had to abandon them in 1974, have the opportunity of having their properties returned to them, as they are not inhabited.

Accordingly, they could consider making applications to the IPC and claiming the restitution of their properties. Currently, making such an application to the IPC is the legally most solid path to reclaiming such properties.

Our recommendation for Greek Cypriot or foreign persons who owned properties in Varosha in 1974 and who wish that their properties are returned to them is to make applications to the IPC early on, to reduce the time needed to achieve a result, as the IPC would be treating the applications in the order they are received.

Everyone shall provide their TRNC address upon the registration with the application ̈vendekal before traveling to Northern Cyprus. The person will be able to stay in quarantine at his/her residence, friend’s/relative’s or rented house.

Children under the age of 12 are not required to register at the application “Güvende Kal”.

All the countries are divided into 5 categories. Each country has certain colour: red, orange, green, dark red or grey. Country colour depends on the number of new cases for the last 7 days and clarifies as follows.
☑️Red– 5 days quarantine if the person is vaccinated or 7 days quarantine for those who are unvaccinated.
☑️Orange– 5 days quarantine or quarantine-free entry providing vaccination passport/statement
☑️Green – without restrictions for vaccinated and unvaccinated passengers
☑️Dark Red – entry is not permitted except TRNC citizens and international students providing students engagement letter.
☑️Grey – 14 days quarantine regardless of vaccines.

Country colour updated weekly – to be confirmed each week (updated as of 9 August 2021).

The authorities will take into account the colour of the country of initial departure, where the passenger had been staying for at least 10 days, and not the country being transited.

Those who has two vaccines are subject to the quarantine, if they have visited a Grey or Red Country within the last 10 days. In this respect, the person who travel from the country either marked as “Red” or “Grey” must undertake 5 or 14 days quarantine accordingly and take PCR test.

✅However, if a vaccinated person travels from the UK, she/he will be able to enter the country without quarantine.

Everyone must take the second PCR test at the entry to Northern Cyprus.
