Changes to the rules around carbon monoxide and smoke alarms in England and Wales.

Draft legislation has been published to amend the regulations for smoke and carbon monoxide alarms in social and private rented properties. It is expected to come into force 1st October 2022.

What is new?

New Regulations drafted state, that all rented properties in England must provide a carbon monoxide alarm in rooms used as living accommodation where there is a fixed combustion appliance, such as gas heaters and boilers.
Install a carbon monoxide alarm in every room where you've got combustion excluding a gas cooker.
Gas cookers don't fall under these new regulations and therefore no carbon monoxide alarm is required in a room with one.

A reminder about smoke alarms

You should already have a smoke alarm on every story in your rental property.
The smoke alarm should be fully working and tested at the start of the tenancy.

What is new about smoke alarms?

From 1st October 2022 we believe it will be the landlord’s responsibility to repair faulty smoke alarms once advised of the fault, whilst we believe it is still the tenant responsibility to replace the batteries.
Smoke alarms should be tested at inspections.
Smoke alarms should be replaced by the landlord on their expiry date. Battery powered alarms have an expiry date.
We believe battery powered alarms are satisfactory and there is no legislation to force hard wired alarms at this time.

Top Tip – if the tenant is responsible for changing the batteries, make sure the alarms are accessible and the tenant has the means to reach them. This is not as important if you have chosen 10-year sealed CO2 alarms which do not require battery replacements.

How can we help?
As part of our fully managed service, we will be testing alarms at inspections where we can access them. This will be noted on our property inspection document.

What do you need to do?

You can pick up CO2 alarms at most DIY stores and fit them yourself. If you would like us to fit your new CO2 alarms let us know [email protected].
